SAN ANTONIO -- KSAT 12 News has learned that the district attorney's office is reviewing a sexual assault allegation made against a person associated with the San Antonio Spurs.
It's KSAT's policy not to name an alleged rape victim, and the station is not naming the person accused because he has not been charged.
According to a police report obtained by KSAT 12 News, the 30-year-old woman claims she was sexually assaulted on March 18, 2004. She did not report it until Jan. 4.
The woman is from Fond du Lac, Wis., where she initially went to police claiming she'd been sexually assaulted in San Antonio.
Although her name and the accused person's name are blacked out on the station's copy of the report, police sources said she names a person associated with the Spurs as the man who allegedly attacked her.
"Without getting too graphic, I can at least tell you that's she alleging a sexual assault occurred at a hotel room here in San Antonio," said Sgt. Gabe Trevino, San Antonio Police Department spokesman.
The report states the alleged assault happened at a Marriott hotel in the Medical Center area.
The woman said she was in San Antonio for a follow-up doctor's appointment, when the man came to her room around 10 a.m.
She told detectives the man ordered a pornographic movie without asking her and then went to the bathroom.
When he returned, the report says he walked over to the woman and began to kiss and fondle her.
She alleges he pulled her to the bed, took off her clothes and sexually assaulted her.
The woman told detectives she screamed and begged for him to stop but he did not.
San Antonio investigators have contacted the man.
A police source said his attorney got involved right away. Shortly thereafter, the woman signed a complaint waiver, which means she did not want to cooperate any longer.
"We've completed the investigation, and we're going to forward that over again to the district attorney for a review, complaint waiver signed or not," said Trevino.
KSAT 12 News was unable to contact the woman in Wisconsin. She would not answer her door, and she disconnected her telephone.
An attorney for the man has also been in contact with the woman. He claims to have a signed affidavit from the woman saying she made up the story.
A sex crimes detective took the case to the district attorney.
"Ultimately, the district attorney has to make the decision on whether they will present it before a grand jury or even prosecute the case," said Trevino.
The Bexar County district attorney's office did not comment on the case Friday night.
