SEC accuses Mavs owner Cuban accused of insider trading

WASHINGTON -- The Securities and Exchange Commission has accused Dallas Mavericks owner Mark Cuban of insider trading.

The Wall Street Journal on Monday reported that Cuban is alleged to have dumped shares in Mamma.com upon learning it was raising money in a private offering.

In a civil action, the SEC claims Cuban sold his entire 6 percent stake in late June 2004 after learning that Mamma.com was raising money through a private investment in a public entity (also known as PIPE), the Journal reported.

The following day, Mamma.com announced the PIPE financing and shares of the company dropped by more than 10 percent. By selling his ownership stake, Cuban avoided more than $750,000 in losses, the Journal reported.

Read the complaint - of course he knew what he was doing was illegal. That's why he was pissed, because he was receiving information he couldn't legally act on.

$750k is like 4/100 of a percent of his net worth. Not sure why he'd risk going to jail over something like that. For illustration, if your net worth were 250 thousand dollars, that's the equivalent of about 100 bucks. My math may be wrong but I'm pretty sure I'm close.

Well, it's a civil complaint for the time being, so as of yet, no risk of jail time.

There may be down the road. Would you even take a chance over such a small amount of money? I wouldn't. That may end up being his defense.

This is much different than the Martha Stewart case. Mark Cuban hasn't tried to lie or cover up this incident at all, in fact he wrote about exactly what he did in his blog. He'll have to pay $1 Million and be done with it.

Yeah, it's possible. You know I don't credit him as being overly bright, but I just can't imagine he'd try it if he knew about it. Given his history of meddling, I don't think something like that could happen without his knowledge. The difference between him and Martha Stewart is that she committed purjury to try to cover it up, and he appears to be cooperating.
