NEVADA CITY, Calif. -- A 12-year-old girl was forced to take a pregnancy test at school in Nevada City, a lawsuit filed in Nevada County Superior Court alleges.

The Pacific Justice Institute, which is representing the girl, said in a news release that Steve Davis, a counselor at Seven Hills Middle School, pulled the girl out of class.

KCRA 3 has decided not to name the girl out of protection for her privacy.

Davis heard rumors that she was pregnant and wanted to know if it was true, the release said.

Though she denied it and told Davis a classmate had spread rumors about her in the past, the counselor got a pregnancy test from the school nurse and told the 12-year-old to give a urine sample, the Pacific Justice Institute said.

The pregnancy test was negative.

According to the news release, the girl was embarrassed and humiliated, and her parents were angry when they found out.

They worked with the Pacific Justice Institute to get an apology from the Nevada City School District, but didn't receive one.

The lawsuit, filed Oct. 29, 2008, seeks damages for violation of the girl's right to privacy and emotional distress.

"There is no merit in the claim," Superintendent Roger Steel said. He directed further questions to the district's attorney.

Reached at home Monday night, Davis said he had no comment on the lawsuit.

No merit?! If it was my girl I'd be PISSED! Just because some stupid kid said she was pregnant they did that? What bullshit. I would sue just to teach them a lesson. It isn't even about the money, it's that they don't see anything wrong with that.

My kids are being raised to respect adults no matter what. But I think that, in that particular situation, I'd feel perfectly comfortable advising my girl to tell that counselor to go fuck himself. And frankly, I'd have his background investigated from every possible angle. No man is going to order my daughter to piss on anything without my becoming very suspicious.

what was the purpose of the pregnancy test? If the girl turned out to be pregnant, then what? Does she have to wear a sign around her neck?

So, they're not allowed to dispense an ibuprofen at public schools, but they can administer a pregnancy test? I hope this school gets what's coming to them, because that is absolutely insane.

JISD will dispense Tylenol if you give them a note with the dosage your child is allowed to have. But a pregnancy test? WTF?

It's more than that. If this goes unchecked, not only can the school administer a pregnancy test, it can all but order any female student to take the test, even if the girl expressly denies that she's pregnant. If that's permissible, why not allow the school to mandate blood draws for drug testing whenever the principal thinks a student might be using drugs?

I realize that a lot of rights end at the schoolhouse door, but this sort of invasion is absurd.

It is sad, but I think they keep them for the sake of that one girl who might come in to confide in the school nurse, and be looking for some help.

I know this might not make sense but every time I read about a member of a school faculty doing something stupid like this, I always think that it's not the actual act that disappoints me, but the fact that they don't have the common sense to know better, I guess because it means that they could do a lot of other stupid things.

Again- only one side of the story. Maybe she was worried she was pregnant and the school helped her out, but then her parents found out and she lied about it. It is just as feasible as the notion that a counselor and a school nurse would be involved in forcing this against her will.

That counselor is an "Insensitive Dick"! If he wants to have that much control over people, he needs to apply for a job at a prison.
Normally I don't think people should sue, but in this case I hope that man loses his job.:toast How would he feel if his boss made him take a Herpes test just because he heard a rumor?
