I didn't mean to start an uprising. :lol

If I remember correctly, it was a lot of work. There's the design, if it was updated. There's the work of getting shipping costs around the world, and then getting them packaged and shipped. Not to mention the handling of the money, both up front to get it made and then the way payments tend to dribble in.

I'm in for buying one, but someone has to do the work. It's not a small task.

I didn't remember that, if it was made public. I had the thread handy from the Clippers game, I wanted the SpursTalk logo. Sorry to stir stuff up, that wasn't my intent. :)

legal reasons? i would think not using the spurs logo is enough to get by all the legal mumbo jumbo. maybe i'm wrong?

they have a logo... they have a few trademarks... but nothing spurstalk or spurstalk.com unless the spurs organization went and registered those behind your back. hmm. oh well.

if there's a demand... sooner or later you'll see it on the side of the street under a little tent surrounded by other bootleg shirts. haha.

it contains the word "spurs" which is owned by the team and nba. it would have to be licensed by the league and/or team.

and let's not do anything stupid or bootleg to fuck over the incredibly nice people who run and pay for this great free site.

haha... i don't think they could trademark "spurs" but maybe i'm wrong? guess i'll just go trademark "basketball" or "association" or "national" right now and see what the nba thinks of that.

ps: don't read to much into my last reply. i am not for bootleggin' and ruining the ST name. i was simply saying if there's a demand there is bound to be a supplier show up sooner or later.

they definitely can trademark and own team names. doesn't mean you can't own a bar called "the spur" for example, but if it were a basketball-themed bar with a black and silver color scheme, that would definitely be an infringement. a lot of it is about context. and the context of an ST t-shirt is clearly basketball-related.

How can they own the word "spurs"?!?!?

Oh and just for the newbies here's the original design. It's a rarety among collectors and worth big $$$... :lol

so is the spurs bar right off of walter st i believe it is and it's decked in black n silver.

i'm no lawyer so i can't be for sure.

Ya, think about this. You can legally own and operate a website called "SpursTalk", but you cannot print a shirt with the word "Spurs"? So I guess the makers of real http://www.horsetackinternational.com/images/IW200-Ladies-spur.jpg

had a raging legal battle with our San Antonio Spurs.

I can understand not using the NBA logo, or the Spurs logo, but SpursTalk should be allowed.

its about selling it and making money off it. you can make your own t shirt that says spurs but if you sold them, then you could have a problem.

So they cannot market their website by selling T-Shirts, but they can own and operate a website called SpursTalk? The variable missing in your equation is $$.

Anyways, perhaps this summer we will try to figure out a way. If there is enough demand, someone bump this thread in the offseason and we'll consult with the required authorities . . .

SpursTalk is not the same as "Spurs." I am confident that there is no legal exposure there.

So they cannot market their website by selling T-Shirts, but they can own and operate a website called SpursTalk?

haha. i'm totally with you on this one. i don't think putting "SPURS" on a shirt and selling it will land you in copyright infringement court.

"Trademark rights may be used to prevent others from using a confusingly similar mark, but not to prevent others from making the same goods or from selling the same goods or services under a clearly different mark."

similar marks... the http://spurstalk.com/forums/images/Style_Templates/Flashskin/misc/navbits_start.gif is a trademark and therefor can't be duplicated without repercussions but the word "spur" or "spurs" is just a word and can be duplicated over and over again. that's how i am reading the law but once again maybe i am not reading it right? i don't know.

same with copyrights.

"The copyright protects the form of expression rather than the subject matter of the writing. For example, a description of a machine could be copyrighted, but this would only prevent others from copying the description; it would not prevent others from writing a description of their own or from making and using the machine."

if you disect that above wouldn't you say the subject matter is basketball but the form of expression is "the san antonio spurs"? so "spurstalk" is just another form of expression which ties in with the same subject matter as "the san antonio spurs" but they are totally different forms of expression.

I thought that SpursTalk did not make a profit when you made the last batch? Also, how can you not be allowed to promote your own "business"? Can you explain how you are allowed to operate SpursTalk with no legal issue? Is it because SpursTalk is not making money? If you were to place banner ads and draw an income because of it, would it change the legal issue?

There are plenty of websites where you can design your own shirt, so it saves the work for everyone, plus you can be happy with your own unique shirts. Plus you can post your work on here and maybe, we can have a contest where we submit our shirts and if the legal issues get cleared up, we can have a competition....

Edit: I can talk to my friend who is a lawyer and see what he says as well.

I would like to contribute with a donation equal to the shirt cost, plus shipping, plus 15% over the cost for all the troubles that Kori and LJ will endure to get me one of these T-shirts.

Donation...yes, sir. That's the name of the game in a non-profit organization.

I think it could actually be a nice promotion for ST and the Spurs as a franchise. All proceeds go to the Spurs Foundation, or whatever. I'm sure something could be worked out that is worth it for all sides. The economy is bad enough to where people will listen to any ideas to get something circulating.
