Photographs of alleged prisoner abuse which Barack Obama is attempting to censor include images of apparent rape and sexual abuse, it has emerged.

At least one picture shows an American soldier apparently raping a female prisoner while another is said to show a male translator raping a male detainee.



Further photographs are said to depict sexual assaults on prisoners with objects including a truncheon, wire and a phosphorescent tube.



Another apparently shows a female prisoner having her clothing forcibly removed to expose her breasts.



Detail of the content emerged from Major General Antonio Taguba, the former army officer who conducted an inquiry into the Abu Ghraib jail in Iraq.



Allegations of rape and abuse were included in his 2004 report but the fact there were photographs was never revealed. He has now confirmed their existence in an interview with the Daily Telegraph.



The graphic nature of some of the images may explain the US President’s attempts to block the release of an estimated 2,000 photographs from prisons in Iraq and Afghanistan despite an earlier promise to allow them to be published.



Maj Gen Taguba, who retired in January 2007, said he supported the President’s decision, adding: “These pictures show torture, abuse, rape and every indecency.



“I am not sure what purpose their release would serve other than a legal one and the consequence would be to imperil our troops, the only protectors of our foreign policy, when we most need them, and British troops who are trying to build security in Afghanistan.



“The mere description of these pictures is horrendous enough, take my word for it.”



In April, Mr Obama’s administration said the photographs would be released and it would be “pointless to appeal” against a court judgment in favour of the American Civil Liberties Union (ACLU).



But after lobbying from senior military figures, Mr Obama changed his mind saying they could put the safety of troops at risk.



Earlier this month, he said: “The most direct consequence of releasing them, I believe, would be to inflame anti-American public opinion and to put our troops in greater danger.”



It was thought the images were similar to those leaked five years ago, which showed naked and bloody prisoners being intimidated by dogs, dragged around on a leash, piled into a human pyramid and hooded and attached to wires.



Mr Obama seemed to reinforce that view by adding: “I want to emphasise that these photos that were requested in this case are not particularly sensational, especially when compared to the painful images that we remember from Abu Ghraib.”



The latest photographs relate to 400 cases of alleged abuse between 2001 and 2005 in Abu Ghraib and six other prisons. Mr Obama said the individuals involved had been “identified, and appropriate actions” taken.



Maj Gen Taguba’s internal inquiry into the abuse at Abu Ghraib, included sworn statements by 13 detainees, which, he said in the report, he found “credible based on the clarity of their statements and supporting evidence provided by other witnesses.”



Among the graphic statements, which were later released under US freedom of information laws, is that of Kasim Mehaddi Hilas in which he says: “I saw [name of a translator] ******* a kid, his age would be about 15 to 18 years. The kid was hurting very bad and they covered all the doors with sheets. Then when I heard screaming I climbed the door because on top it wasn’t covered and I saw [name] who was wearing the military uniform, putting his **** in the little kid’s ***…. and the female soldier was taking pictures.”



The translator was an American Egyptian who is now the subject of a civil court case in the US.



Three detainees, including the alleged victim, refer to the use of a phosphorescent tube in the sexual abuse and another to the use of wire, while the victim also refers to part of a policeman’s “stick” all of which were apparently photographed.

Quite easy. Since the rape of prisoners by other prisoners is supposedly commonplace in America, and since America is by definition a decent, civilized nation, therefore the rape of prisoners is decent and civilized. The only difference in this case is that it is the prison guards and interrogators doing the rape, but really morally there's not a whole lot of difference between actually doing the raping, and just looking the other way while the new guy in the cell block is traded for a pack of smokes.

Really the whole "decent and civilized" line of argument can be used generally. America is by definition decent and civilized, so anything Americans do is by definition decent and civilized, including, hypothetically pedophilia, coprophagia, cannibalism, and medieval forms of torture.

The government is holding back as many as 2,100 never-released images from Abu Ghraib and other detention centers overseas. The ACLU first sued (https://www.aclu.org/national-security/aclu-v-department-defense) for their release 10 years ago, and in August, District Court Judge Alvin Hellerstein ruled (https://www.aclu.org/files/assets/torture_foia_photos_ruling.pdf) that the government must publish the photos unless it can defend withholding them on an individualized basis.


Tomorrow the government will appear in court and tell Judge Hellerstein and the ACLU what it plans to do.


The government based its suppression on a 2009 statute (http://www.dcoxfiles.com/123stat2184.pdf), enacted after the ACLU won the release of the images in the trial and appeals courts, that permits the secretary of defense to withhold an image for up to three years if the secretary certifies that its release would endanger Americans. In 2012, then Defense Secretary Leon Panetta issued a half-page certification (https://www.aclu.org/files/assets/torture_foia_photos_ruling.pdf) for the entire collection, of more than 2,000 images.


"Standing alone," Judge Hellerstein wrote in his August ruling, Mr. Panetta's certification is "insufficient." The government must prove that the secretary reviewed each photo by itself and "show why" the publication of each image risked national security.

In a robust ruling in favor of Abu Ghraib detainees, an appellate court ruled Friday that torture is such a clear violation of the law that it is “beyond the power of even the president to declare such conduct lawful.”

That ruling echoed the widely discredited legal theories of the Bush administration, which argued that the war on terror gave the president the inherent authority to indefinitely detain and torture terror suspects, and conduct mass surveillance on Americans’ international communications.


But the Fourth Circuit soundly rejected that theory, saying that the United States has clear laws against torturing detainees that apply to the executive branch.


“While executive officers can declare the military reasonableness of conduct amounting to torture, it is beyond the power of even the president to declare such conduct lawful,” wrote appellate Judge Barbara Keenan, writing for the unanimous panel.

The trial is scheduled to begin Monday in U.S. District Court in Alexandria, and will be the first time that Abu Ghraib survivors are able to bring their claims of torture to a U.S. jury, said Baher Azmy, a lawyer with the Center for Constitutional Rights representing the plaintiffs.


The defendant in the civil suit, CACI, supplied the interrogators who worked at the prison. The Virginia-based contractor denies any wrongdoing, and has emphasized throughout 16 years of litigation that its employees are not alleged to have inflicted any abuse on any of the plaintiffs in the case.


The plaintiffs, though, seek to hold CACI responsible for setting the conditions that resulted in the torture they endured, citing evidence in government investigations that CACI contractors instructed military police to “soften up” detainees for their interrogations.

A U.S. jury on Tuesday awarded $42 million to three former detainees of Iraq (https://www.independent.co.uk/topic/iraq)'s notorious Abu Ghraib (https://www.independent.co.uk/topic/abu-ghraib) prison, holding a Virginia-based military contractor responsible for contributing to their torture and mistreatment two decades ago.


The decision from the eight-person jury came after a different jury earlier this year couldn't agree on whether Reston, Virginia-based CACI should be held liable for the work of its civilian interrogators who worked alongside the U.S. Army at Abu Ghraib in 2003 and 2004.


The jury awarded plaintiffs Suhail Al Shimari, Salah Al-Ejaili and Asa’ad Al-Zubae $3 million each in compensatory damages and $11 million each in punitive damages.



The three testified that they were subjected to beatings, sexual abuse, forced nudity and other cruel treatment at the prison.
