Eddie Van Halen Sues Nike Over Guitar’s Signature Color Scheme

Eddie Van Halen’s red, white and black splatter-striped “Frankenstrat” guitar is one of the Van Halen leader’s true signatures. In fact, it’s so closely associated with the guitarist, Van Halen had the color scheme copyrighted in 2001. Now he’s suing Nike because he says the sportswear giant put a similar design on one of their Dunk Lows sneakers, Spinner reports.

In the lawsuit Eddie and his ELVH Inc. accuse Nike of treading on his trademark, saying the NYX sneaker did “irreparable harm and damage” to his design. He is seeking both monetary retribution and “the impoundment and destruction of all footwear.” While the sneaker does feature red, white and black stripes on the sole — a popular tri-color combination — it doesn’t seem identical to Van Halen’s pattern, and in response to the suit, a Nike spokesperson said, “Nike’s Dunk shoe design is not substantially similar to any of the Van Halen designs, and Nike has not referenced the ‘Van Halen’ name or image as part of any marketing campaign or promotional material associated with the shoe.”

At the heart of the conflict is the fact that just last month, Eddie Van Halen released his own footwear line, EVH Shoes, adored with his Frankenstrat stripes. Van Halen’s sneakers actually look suspiciously like Converse All-Stars, so unless there’s an official deal in place, he could potentially find himself on the opposite end of a lawsuit soon.


Eddie's Frankenstrat is a classic. Hope he wins.

hmmm. this is a bit of a stretch on eddie's claim. if i were the lawyers i'd get the swatch of the color scheme that he copyrighted. there has to be a swatch. i can't see this drunk, which he was back in 2001, applying for the random scheme of red, white and black. so get this swatch and see if it matches up exactly and go from there. if it lines up, settle. if it doesn't, then piss off.

me too, but I haven't really followed EVH since his first album back in 1978.

I hear that quite a bit but I picked up the guitar because of EVH and as a classic rocker he is part of my rock history.

This is why copyright sucks. If two people happen to have the same original thought, someone gets sued for it. And in this case it isn't even the same. So if this holds, the rights to a red background with random thick white and black lines belongs to one person?

See, copyright makes much more sense on a book or a film, that isn't going to be duplicated by another person on random chance. For a color scheme? Get real.

I've seen those mini-guitars with the Frankenstrat design at Fiesta Texas you can win. I've always wondered if EVH had the right to that design.
I don't really care if he wins or not but any rocker from the EVH era would recognize that design anywhere.

I wouldn't. I'm from that era. It's a random pattern of colors. I used to doodle like that myself. I'm sure you can find similar schemes in all kinds of places. Nike is just a big target that may settle just to go away, and slimebags know it.

It's not even the same color white. Nike's is pure white, while EVH's is yellowish. Could be the lighting in the photo, but his stripes look yellow.

I build guitars, and those Nikes reminded me of the first Jordans, not Eddie's Strat. The only person stupider than Eddie is the idiot that granted him a copyright for some fucking electrical tape.
