I have a live-in helper/lady that has worked for us 6 years. When we lived in our old house and put it up for sale, I began missing a few very expensive jewelry items. (I'm talking about 4,000-6,000 worth). When I inquired about them, she said, I have no idea, so I thought maybe it was the realtors and their clients. Of course, I had no proof, so I hid my jewelry box. Remember she lives with us.

We moved into our new house in 2007. There were plenty of workers who worked in my home, but not in my bedroom. I lost my Breitling gold and diamond watch (4,500) worth and a few John Hardy and Yurman pieces. I noticed the watch right away since I would it wear everyday. I noticed the other items when I wanted to wear them, and they were not in my box. Some items matched like the earrings with the necklace, so I find it hard to believe that a worker would know there is a matching set and have the time to find it in my box. It is a very large box with several compartments.

Also, I've lost 2 dolce gabbana limited edition razr's a couple year ago. I thought I just misplaced them. I also lost my iphone a few months ago and had to buy a new one. Again, I have no proof. Well, she lives with us most of the time, and my Mom finally convinced me to check in her room. I used last weekend to search her room. I found my kids' earrings in her jewelry box. A lot of my costume jewlery in plastic box she had hidden. I found a few of my kids' wallets. My Kippy and BB Simon belts and other miscellaneous items. The items were nothing compared to the real jewelery I've lost but if she's taking small items, I don't think it's a stretch to believe she was the one who stole the jewelry.

I am giving her the boot now. Every Year in August, I give her a paid week of vacation. Now, I don't feel I owe her anything, especially since she won't be working for us the whole year.

Please tell me, When I fire her am I wrong to not give her her paid vacation week money? And, do you think it's reasonable for me to assume she's the one who stole the jewelry?

Do you have any sort of verbal or written agreement that she could hold you to- i.e. prosecute you over?
I would hate for you to set yourself up for a lawsuit, especially since you cannot prove she stlole your jewelry.

The more expensive things have likely already been pawned. File a police report and then you might get lucky and find your things in a pawn shop.

She doesn't pay rent and doesn't have a lease with you so there are no legal privacy issues with what you did. Plus you had probable cause. Deal with her face to face like a man and give her a chance to come clean.

Believe me she does get paid well. There are no issues there. She has her own room, plasma, A/c, kitchen, bathroom and it is on top of the garage and is seperate from the house. I work from home, and she helps keep the house and office clean. She buys whatever groceries she wants about (80.00 bucks a week).

She did ask me for a raise very recently. But, that's when my little girls told me they had seen some of their stuff in her room. So, that's when I checked her room.

I already have a few people lined up that I'm going to try. I just don't know if i can trust anyone after this. And, I need the help since both my spouse and I work.

I didn't plan on paying her any vacation week. But today, I was speaking to a close friend of mine who asked me if she had done a good job, and I said "yeah, but she stole from me, although I can't prove it."

And, he sad, "hell just pay her." So that's when I decided to make this thread. I couldn't believe he thought that. Thanks for confirming what I think is the right thing to do.

You should invest your money better. Spend $4500 on large things that can't be pocketed. If I had thousands of dollars of jewelry/wallets/shoes or whatever, I wouldn't hire some illegal for $10 a week.

Well, she's not illegal and I pay her several thousands of dollars per year, so she doesn't get paid 10 dollars a week...:lol

You might be right about just letting her go and eating my losses. I was just thinking maybe she gave the jewelry to her family but then again, I doubt she would ever return it. So, maybe I won't do the spycam thing. :depressed

As far as investments, I work pretty hard as does my spouse, we can afford the items. Our investments are not dependent on extraneous items like jewelry, they are just gifts, but they meant a lot to me.:toast

As someone else stated, if she's living in your house with no lease/rental/boarding agreement, I'm pretty sure all bets are off. Your home is her place of employment. Where I work, loss prevention has the right to search my locker or my backpack if they have reason to suspect I'm stealing from the company.

Sounds to me like you have enough evidence to prove she ripped you off. You should feel free to fire her and pay her only for time she has worked but has yet to be paid for. If you had to let her go for financial reasons, I could see feeling bad. But, this bitch ripped off you and your family. As sensei Kreese says....NO MERCY!!!

Fire her, kick her out immediately, give her a day to get all her shit out. Done.

You definatly shouldn't feel bad about firing her and not paying for a vacation. The vacation is a reward, and she certainly did not earn it. It's nice of you to let her have the week to get set up to return home, although I agree with the others that it could be a risk. Plus, does she really deserve the courtesy? Anyway, hopfully it all works out for you and ends smoothly.

If you are going to be so unbelieveably nice (naive?) to let her stay a week, then at the very least:

Change the locks to the main house. She can stay in the garage apartment but no acess to anything else valuable.

To be honest, out of concern for my kids safety, I would insist on her being out right away. If she was willing to risk stealing BIG ticket items before, now that she knows she's out in a week what if she gets desperate and does something worse?

I didn't read this whole thread but I think putting a camera in her room is a horribly bad idea, why wouldn't you put it in your own room where the items being stolen are located?

I'd just get her out and cut my losses, and next time invest in a safe.

Yeah, you're right, the camera should be in my room not hers. But, it's not going to change anything now, so I'm just going to fire her.

Problem is, even if I were to call the police, I can't prove it. The items are gone. And, yes I've been real pissed about it, but what can you do? Aside from firing her, nothing. I mean, I'm not a Soprano or anything.:depressed

Others have said it, but I'll go ahead and repeat it, I think it's a terrible idea to allow her to stay for an additional week after you fire her. There's no telling what might happen. Keep emotions out of it. She's already betrayed any personal trust there was. Firing her is a simple business decision, no need for you to feel bad or guilty. She put herself in whatever predicament she finds herself in. Your sympathy for her is misplaced.

And I'd strongly suggest you change all the locks to the house. You have no idea if she's made copies over the years.

As for the vacation, my company made us all sign something that says that they won't even pay us vacation we've accrued if we are let go. If it's good enough for the corporate world, it's good enough for you.

Thanks for looking out, but I'm definitely okay on the legal side--I'm pretty well versed in it since I have a JD:lol

My question was really a moral one. I wanted to know if people thought it would be okay if I didn't give her money for a paid vacation that she usually takes in August and I'm sure she is expecting. Just a moral question. Many of my friends always thought I was too nice but she was like family. She lived with us for 6 years, and she helped us during a lot of crazy times. I'm more disappointed than anything else. There are no contractual agreements between us. So, I am not worried about any legal ramifications.

Well, I waited until she left for the weekend to go through her room again. OMG!!! We hit the motherload!

That bitch had stuff in between her mattresses!! She had a couple cameras, CD players, and jewelery in between the mattresses. She also had many of my high end clothes that still had tags on them rolled up in a sweatshirts. The best part was finding a whole black bag of valuable jewelry she had wrapped hidden in between a sweater. Yes, this was worth a lot, and it made me realize how much and for how long she had been stealing from us. I am telling you, this bitch was a professional. I literally felt sick to my stomach.:depressed

She even had our stuff in her shoes! I kid you not. I found rolled up belts in her boots, and I even found one of my cell phones in her shoes as well. She had downloaded all her shit and had pics in it. Needless to say I was fucking livid!!!! I was shaking I was so pissed off. I could go on, but it's been a very long day.

We packed all her shit in trash bags! I picked up her Mexico passport and her documents and made copies of it and her social security card. I called the security guards up front and told them to barr her from entering and to take her name off our list. Thankfully, she had left the gate control so she couldn't use it to open the gate to our home in the event she somehow got passed the guards. But she did still have our keys.

When we went to pick her up, we retrieved the keys from her and told her she was fired for stealing and to GTFO. We told her we packed her shit in trash bags and when she could pick it up. She was Shocked! She looked like a ton of bricks just hit her. She was about to bawl, so we split.

That's the end of this awful story.:(

The one thing I'm going to do though is call that weather lady Shioban Anders (the red headed meteorologist) she recommended her to me 6 years ago. I need to let her know she's a thief before this lady gets another job with one of her friends. I just can't find her number it's been so long.

Not to be a dick but the next person might not be able to handle the monetary aspects of a situation like this as well as you might have, or they may loose items that have more than monetary value, or God knows what else could happen, a thief typically winds up stealing bigger, more valuable items as time goes on.
