I think we should clarify. Are these underage drivers real or imaginary? Are they Salvadorian?

This is a question NO civil rights advocate will answer. It's yes or no. A simple question. A police officer thinks the person driving next to him is 13. Should he pull the car over to check things out? :lol

mookie2001
10-03-2009, 03:36 PM
no, because if theyre really 13 it should be easy as hell to pull them over for a traffic stop

police do it and say it all the time, if they want to pull someone over, theyll follow them until it can be argued that they might have broken a traffic law

What should the Police officer do?

It ok in your book for a 13 year old to drive. :lol Let the 13 year old drink, vote, go to strip bars and fight in wars! Parents shouldn't be held responsible for 13 years old. We shouldn't ask for ID. I guess if a 13 year old fucks a 40 year old it's ok. Why have laws, why have police. That is what you are saying.

im 30 and look young for my age. when i got my D.L. i prob looked 12. anyway i got pulled over when i was 16 and before the cop ever came to my vehicle there were 6 other squad cars there. so he said i looked too young to be driving, i gave him my DL which he took back to his car for 2o minutes while i sat there with 10 cop cars, lights on, all around me. he came back laughing and said sorry have a nice day.

I would think the cop would have better things to do than pull over a 13 year old. However, since there's a good chance the car is 'borrowed' from the parents, or stolen, I wouldn't have too much of a problem with him pulling the kid over.

You would think everyone would think that way. You would think if a neighbor called the police because they thought someone was breaking into a house the cop should be able to ask for ID when they get to the house with out national incident. AKA beer summit.

i'd pull him over and tell him he'll never be a wide receiver if he doesn't exercise.

Oh, Gee!!

A(n) easy question.

fixed. and if the cop has reason to believe the person is violating the laws (i.e. driving underage), he should pull him/her over and investigate. The investigation should take all of three minutes.

Yes, but technically you don't have to show a police officer an ID, and depending on the circumstances, not even your name.

http://www.cnn.com/2004/LAW/06/24/dorf.police.id/index.html

All nine justices agreed that a person who is not behaving in a way that gives rise to an articulable suspicion of criminality may not be required to state his name or show identification.

And the decision that you have to give your name? It was only approved by a slim 5-4 majority.

Was the guy a dickhole? Sure. But he's within his rights.

Edit: An example of how it works is provided later..

Interestingly, Justice Kennedy's response to Justice Breyer's Fourth Amendment objections made his argument somewhat more vulnerable to the Fifth Amendment objections posed by Justice Stevens. Suppose one agrees with Justice Kennedy that the requirement that a suspect identify himself is indeed justified on the ground that his identity is relevant to determining whether he has engaged in criminal conduct. On that assumption, the requirement to identify oneself (or be prosecuted) appears to be a requirement that the suspect not just identify himself but in the process incriminate himself -- in violation of the Fifth Amendment right against self-incrimination.

Is the driver black?

You know those black kids already drive faster because of reverse discrimination and stereotyping in grade school.

It was obviously an allusion to pulling over somebody if they look like a criminal. In Jack's mind criminal = minority. so he hides behind a couple layers there in order to be able to pull out the race card.

If the law allows the cop to pull someone over merely on the suspicion of underaged driving, then yes. If not, no. As mookie said, cops have no problem finding legitimate reasons to pull someone over.

You clearly brought up color with your other thread on top of mentioning civil rights advocates in this thread.

What is the point of this thread?

If there is a point then you are stupid. If there is no point then you should keep your day job. Either way, I doubt anyone argues against you winning the dumbass of the day award.

Just read this thread. I never mentioned race or color until that douche did. I don't see color. I am equal oppurtunity kind of guy. A man of the people for the people. What you are referring too,I saw a man doing his job and another man giving him a hard time. I never mentioned color or race. If a cop thinks someone is breaking the laws he has a right to check things out. Let him take a peak in your trunk, show him ur ID if he ask, , be polite, it's all good people. The bad cops will get theres.

Well you can't quite fault people for thinking there was some partial racial aspect to your post, as many thought race played a part in that issue.

Would it make more sense for people not to be dicks to cops? Of course. But, in some cases, they do have the right to.

If you don't want the cop to look in your trunk, then you don't have to. It's your freedom from unreasonable search and seizure.

It would be nice to talk about race without people getting all upset or thinking you are a racist. I really really really was hoping with Obama being president that would change. Instead I see people on the tube telling me if you don't support Obama's policy you are a racist. If you call Obama a socialist you are being a racist. Another topic for another day. Later.
