I got pulled over almost 2 years ago for reckless driving.... It was just after I got my G8 GT. I was leaving "wendy's" off of Fredricksburg across from Crossroads mall.... I got stopped at Fredricksburg and 410. I will admit, I was having "fun" with my vehicle.
Let me not get ahead of things though.....
Game 3, Spurs vs Mavs, 2009 finals.
I went to a friend of a friends house. Turns out this guy was a dealer. I dont give a fuck, I feel safe enough with my friend and they aint giving me shit about refusing stuff... So we are there partying and we are almost out of beer.....
Now, I was proud about my car when I bought it, probably too proud.... My car was in the back of everyone else, and Im pretty drunk at this point, so I say "Take my car, just be carefull and you will fucking take over payments if you fuck it up!"
Everyone laughs.
So I give the guy my wallet, which containts my license and insurance if he gets pulled over. Nothing happens. He comes back with the beer and everything is cool....
Fast Forward 3 weeks.
So, I got pulled over after leaving "Wendys" and think nothing of it.... Cop asks for my insurance which is in my wallet.... No problem.... They ask to search my vehicle... no problem I say... What do they find? a baggy less than 1 gram on my floor board.
Fast forward almost 1 1/2 years later, I go to court tomorrow for something that wasnt mine.... Had to shell out $4000 for an attourney because I make "too much money" for a court appointed.
The guys house that I was at? It got raided almost 8 months ago.
Now, dont get me wrong, I have done some shit... used to smoke daily during the summer when I was in school, Used to do Acid and yes, I used to do coke... I NEVER got into that shit... That was back in highschool, 12 years ago, and have never done it since....
Tomorrow, I face a charge that so far has cost me $4000 for my attourney and we will see how bad I get screwed for something that wasnt even mine.

Why did you put 'Wendy's' in quote marks? It's just plain ol' Wendys. Good luck though.

There are alot of other "why's" that I should have taken care of.. I should have thouroughly cleaned my car.... I should have never let them even take it.
I should have never given him my wallet...
I should ahve just backed out and let someone else's car go....
People do stupid shit, and I'm paying for it....
I hope this is a lesson to you people.
I have been clean since highschool... But here I am, 12 years later, going before a judge to defend myself because I was an idiot trusting people I dont know.
Learn from my mistakes is all I am saying.

In anycase, if I am a free man tomorrow, I will let you know what the judge decided....
If you dont hear from me, well, Im probably in prison for no other reason than hanging out with the wrong people.
Not trying to rub things in or anything, but you broke a cardinal sin that could've helped you avoid this entire situation.
Never, ever let anybody else drive your car without you, short of maybe your spouse or your own kin. The only person who drives my car is who is listed on the insurance, and that is me alone.
Good luck with everything.

your lawyer robbed you if you are facing the possibility of any jail time for under a gram of coke and it's your first major non-traffic related crime

Classic not my fault attitude! Why did the cop want to search your car? Did he have some super power knowing the drugs were on the floor board, or do you look like a damn junkie? My guess the latter. Anyway you'll probably face a fine, AA, community service, and probation. In the future dont be such an idiot, what are you 31 -32? Dont you think its time to grow up?

Honestly you should have just not been a pussy and went to jail for the gram. You would've spent like a night in jail, and now you have to pay thousands of dollars for a lawyer and legal fees for some shit you didn't do. Next time, grab the bag out of the officer's hand and eat it. It's only a gram.

Also, memorize the phrase I DO NOT CONSENT TO ANY SEARCHES OR SEIZURES, OFFICER.
Cops like to make you think they can do whatever they want and often trick stupid people into letting them search their cars and shit.

Sorry, phyzik, that sucks.
Never let anybody into your car that you don't know super-well. Even then, never let them in without you there to supervise.

Man, talk about a series of unfortunate events! Judging by your previous drinking thread, I'm glad you're reaching an understanding of the negative effects of alcohol in your life. No matter what happens tomorrow, you are still a young man, a bit more enlightened, and have no reason not to be able to get past this and move on to a better path. I wish you the best :toast

I don't know what Phyzik looks like, but you make a good point about what made the cop feel he should search the car. And I have to say it's probably the car itself.

You had 3 weeks to look through your car after some known druggies were in it, and you didn't even notice some coke on your floorboard?
Damn, man.

The 4k is worth it. You don't want the court appointed attorney.

If he's going to trial without a deal for less than a gram it sounds like the one he's got isn't worth a shit either.

<1 gram of coke is still a state jail felony.
the baggy was in his car.
The prosecutor has an easy case to try here, based on what's been presented so far. I'm betting the plea deal still involves some jail time.

Should have plead no contest to possession if you had no priors. Would have cost a lot less than the $4k, that's for sure!

No jail time....
Deferred judification for 2 years
150 hours community service
$1500 fine
Judge also slapped on I have to attend AA meetings 3 times a week for 9 fucking months!
Hopefully there is some way to have my probation officer request to have that dropped after some time showing that I am, indeed, sober.

If you have no priors you have to get probation for under a gram. It's required by law. Most minor felonies you can get deferred adjudication if it's your first offense.

thats probably the best case scenario imo. AA meetings could be fun. you'll meet lots of drinking buddies there.

AA for 9 months? That fucking sucks ass. You're going to be spoonfed a bunch of fucking religious bullshit and pressured to make AA your entire social life. It's sickening the shit they teach people about how they're powerless to fight the demons of inanimate objects like alcohol or drugs as if you have no personal choice or accountability. AA is a fucking nightmare which has a success rate of like 5%; the same as for alcoholics who don't attend that bullshit.

Considering the thread you started a few days ago, I'd be very surprised if your time in AA leads to a revelation of sobriety. Especially if the probation is structured to ensure your active participation in the AA meetings -- likely hard to hide your daily consumption of 12+ beers if you're required to share and/or get a sponsor.
