I think Fish was under pressure by big name players to get going. They are losing a shit load of money and it's not going to get better if they don't start playing ball (literally and figuratively).

Fish had no leverage.

The lawyers and Hunter stood to make money, not lose it, on the path they were headed. The players were bleeding money.
