If you're talking about GM, it did restructure under bankruptcy, but it was closer to filing under Chapter 7 (complete fail liquidation) than under Chapter 11 (restructure) before the U.S. capital infusion. I'm pretty sure the congressmen who said "let GM fail" knew that.
