apparently, most of the jurors were not smartphone users. But something does seem fishy here.

It was a simple mistake, assigning damages to two parts of the complaint they said "no" to. Question begs... How many other mistakes did they make.

You have no clue what you are talking about. Apple offered Samsung a package to license these patents (which MS took), and then went about their business and got sued. Pretty simple. Samsung's legal team is obviously not the best.

Their best contributions to the market have always been "the next best thing" to the iPhone. Their strategy was always to fill the voids, the areas that Apple had seemingly neglected in their designs. They rarely sought to innovate, choosing instead to build on what they perceived to be Apple's weaknesses.

If nothing else, these rulings will serve to spur actual innovation. You know, that thing that in a few years time made Apple one of the most valuable companies in the world.

Apple makes an awesome product with their phone. But they also have seemed to hit a wall in their own creative ways with the "cell phone". More specifically, the Samsung Galaxy line has shown to be of the level and arguably better than the Iphone product. I don't think they are "the next best thing to".... they are already there. Look at the sales of the Galaxy 3 for example... and this phone (physically) does not look like anything of the iphone. And watch we will see Iphones becoming bigger (screen)... something Samsung practices.

Apple had the best recipe lasagna for sometime. Usually if you want to make a better lasagna, you use the same recipe that the best one made and tweak it in other ways. But now with lawsuit BS, Apple thinks they have the patent for ricotta cheese.

I know what you are saying. Thing is, there is a large grey area in these cases. Did they copy what consumers liked? Yes. Did they copy code? No.

Where do you draw the line? My point is that the silliness of the lawsuit was as silly as part of it being the patent on the rectangle design.

What's flaky? Both sides asked the judge for 15 mins to review the verdict after it was handed, which the judge granted, and so after the verdict was read, Samsung took it's 15 mins and sought clarification on a couple of damages on some devices. The judge then requested the jury to sort those issues out, and that was that.

This is nowhere near the end of this anyways. Even if the judge goes ahead in the Sept 20th hearing and bans Samsung from selling some of the devices, Samsung will appeal regardless and seek a stay so it can keep selling them.
