DailyKOS has learned that it will happen between 10-11 am ET tomorrow. Apparently Bob Novak's sources say so too.

It looks like we'll be saying "Chief Justice Scalia?" soon enough.

The big DC rumor is that Rehnquist will announce his retirement tomorrow between 10-11 a.m. ET.

If that happens, would Bush split the difference -- Gonzales and some winger to pacify the Dobson brigades?

It's not the first two the liberals need to worry about...it's the third.

Rumor has it that Bush will get to replace Bader-Ginsburg this year or next.

Whether Chief Justice Rehnquist retires today or two years from today, I'm pretty sure that we won't see Chief Justice Scalia. If an Associate Justice is nominated for elevation to Chief, he or she must be re-confirmed by the Senate. (that's what happened when Reagan elevated Rehnquist in 1986 and appointed Scalia as an Associate Justice). If Bush is going to have to deal with two appointments already, he won't likely elevate anyone, because that would require 3 confirmation battles. If he's going to elevate anyone, I'd be shocked if it was someone as divisive as Scalia -- that confirmation battle would likely be a bloodbath.
