On Banda's FB page his friends are saying he was the passenger and they know what really happened.
It doesn't sound like the cops had any real evidence that Barajas shot him. I thought this was interesting...
ANGLETON, Texas (AP) — A Texas father's claims he did not fatally shoot a drunken driver who caused an accident that killed his two sons seem to have received a boost from testimony by prosecution witnesses.
David Barajas (bah-RAH'-hahs) is on trial in the 2012 shooting death of Jose Banda. He is accused of shooting Banda near Alvin minutes after the intoxicated driver plowed into a vehicle Barajas and his two sons had been pushing along a rural road.
At Barajas' trial Wednesday in Angleton, an ex-deputy and a current deputy told jurors they failed to note in reports that more gunfire had taken place well after Banda was shot.
Banda's cousin later Wednesday gave contradictory testimony about whether Barajas had hit Banda before shooting him.
Alvin is 30 miles southeast of Houston.

If USA, or TX, would lower the limit to 0.04 or 0.05 with immediate loss of DL for 2 years at FIRST OFFENSE followed by 5 years of probation, then maybe there'd be less drunk drivers.

no eyewitness, no gun, no residue, no confession. I understand the jury's decision. They can only base the verdict on the evidence, and this prosecution had none.
