View Full Version : Anybody have advice on combatting speeding tickets, tbh?

Prior to today I had never been pulled over for speeding, am usually pretty good at being a boring/safe driver. Was heading back to LA from Mammoth (about a 5-6 hour drive), and got pulled over on the highway (was a 65 zone). I wasn't below the limit (tbh, on an open-road 2 lane highway, nobody is) but I wasn't going fast enough to fear getting pulled over. Saw the cop going in the other direction, didn't bother slowing down or anything, since I wasn't going at a speed where getting pulled over even seemed plausible. Guess he busted a U and pulled me over about a mile later.

First the guy says he clocked me going 87-88 while we were driving toward each other, and claimed he got me going the same speed with his rear radar (didn't even know that was a thing). There was no chance in hell I was going that fast... or anything near it. Going 88 in a 65 could be cited as reckless driving. He then asks me if I've ever gotten a speeding ticket before (no)... then accuses me of having illegal tints on my windows. I told him I don't have any tints, and he says "oh, ok. you're right these are factory :rolleyes."

He goes back to his car, comes back with a ticket which says he clocked me at 75 :lol... I know the guy is completely full of shit, and after doing a small amount of research I came across this, from a guy who got pulled over with the same shit in the same county.


Had a radar detector and reduced my speed to 65-70. The officer said my speed was 88.

What's annoying is, if i wanted to have my day in court, I'd have to go all the way there (about 300 miles), but fuck it, i'll just try to extend and extend and make a trip out of it :lol. There's no way I'm paying this ticket without a fight... worst comes to worst I'll have a trial by declaration. If you were taking this ticket to court, how would you proceed?

How cheap are you? Just pay it. You got caught so why are you fighting the ticket for? No matter if you weren't going as fast as he said, you still were over the limit.

I'm in grad school, so i'm quite cheap. I've also had trips to Las Vegas and Mammoth in the last few weeks, so I'm in no mood to pay another few hundred dollars, particularly if the citation wasn't deserved. I wasn't even going as fast as the 75 I got cited for. I'm not just gna be suckered into a paying for this shit.

Sure. I don't see which parts of civil procedure, torts, contracts, or legal research/writing (the courses I've taken so far) will really come into play when it comes to this situation.

I'm always open to suggestions from those who have experience in the matter. A shelve stocker who has gotten out of multiple speeding tickets would probably know more on the matter than somebody who has taken a semester of law school and has never argued for a ticket before.

I've also been living a parsimonious life since my rookie year tbh, so I can pretty well understand it. Sometimes the thugs in uniform just catch you for no reason, shit happens imho. There's no point in appealing against it or going to a law court because shit would screw you up even more, like my nigga SL said, just accept it and pay it. There's no true justice in the society, just a lesson of life you gotta learn.

What exactly are you going to tell the judge, Philo? I was going 68 not 75? That shits not gonna fly. The cop seems like a power hungry, bottom of the totem pole nigga but you're still fucked. Best case scenario the judge orders you to take the defensive driving class...but then you'd have to make another trip to show you've completed it.

You can do the usual's people say which is try to extend to a point where the cop can't show up which helps your case, ask for the calibration test date of the radar, things like that. Easiest thing to do though is to take a DD course or try to get deferred adjudication which would probably end up as a probation period.

there were other cars on the road around me... pickup trucks and SUV's mainly (it was a skiing trip). how the fuck he can be so certain that his radar didn't pick up something else, instead of my small-ass honda civic, in that split second, considering we were driving in opposite directions. it was clear and sunny and he was wearing sunglasses the entire time. he was alone and operating a radar while driving... easy to make a mistake. he told me i was going 88 and then cited me at 75. was he lying then, is he lying now, or both? "doing me a favor" isn't gna cut it.

i'm going to request discovery for everything i can, radar calibration, training, etc. i doubt he will be a no-show, its a small county

i've seen more than one story on the web of people in the same county being told they were going 85+ only to be cited for less. its fishy. if i bring those up to the judge, i can argue there's a systematic flaw in their approach.

also just to add, at no point did i attempt to assault the officer, reach for his weapon, storm out of my vehicle, make sudden movements or quickly reach for my pocket.

A friend of mine got a ticket for going 52 in a 45 zone. I remember her pleading that asshole and that fuck could care less. The smaller counties do this very often. The county judges are just as bad, so i'd just pay the ticket if i were you.

From my experience out in the West, Washington State patrol are the worst. California & Oregon come next. Idaho, Montana & Nevada cops are the laziest.

If you didn't give the cop a reason to remember you, there's probably 15 things he'd rather be doing that show up to court to contest a petty speeding ticket.

Fight it, I'd say you have an 80% chance the cop doesn't show.

Just pay the ticket man. I know it sucks having to pay for something that 90% of people do anyway, but you did go past the limit and that's what matters...

Take responsibility and start driving like an 80 year old. I know it's tough driving slow when everyone else in the road drive 10kmph faster than the limit, but at least you're safe and there's no way they ticket you.

Did you read my post? I've never plead guilty or no contest to anything other than an expired sticker, but that's obviously not one that makes sense to fight.

Cops don't like to appear in court bro.

Defensive driving would be a hell of allot of less hassle (and much cheaper) then going to court so I would definitaly do that especially since you do admit that you were over the speed limit but its the speed that you are not agreeing on. but thats just my opinion

There is that off chance that the cop wont show up and case would be dismissed in court but thats a gamble.

Just go to court and tell the judge what you said here. Your Honor, the speed limit was 65 mph and I know I was speeding although I can't say for sure how fast I was going but it sure didn't seem like 75 mph, oh and this cop is a liar. I'm sure the judge will dismiss.

Or you can do what the rest of us do, pay the ticket and take defensive driving online to keep it off your record.

You should have told the cop that. I've been stopped once and was a passenger once when my brother was stopped, and when we denied speeding first thing cop asked was "were you using cruise control?" Apparently it carries some weight with them.

Traffic school is worse than a root canal. I did one good one, up at the mall community room. I kept going to the bathroom and walking the mall. I'd come back stay 20, then window shop for 20 minutes. Otherwise I'd a went out of my mind.

Bro, read the quote he provided. It clearly says the ticket would be dismissed.

You can't just go up there with a DD certificate though. At least here the judge has to let you know if you qualify for it first, then you'd have to make a return trip at an agreed date to show you've completed it. You probably would qualify though since you mentioned you have a clean record otherwise.

you are fucking dense. any shmoe can walk into a court and say "i didnt do it"... regardless of whether or not they are innocent. i could have been going exactly 60 mph, but i cant just walk into court, say that, and expect to win. the purpose of this thread was to see if anybody here had contested a speeding ticket, and just pick their mind on how they went about it. instead, here we are

that's fantastic. i know how traffic school works. you still pay the court the fee, which is essentially the price of the whole ticket. for a basic speeding ticket the base fee is like $35 or something low like that, and the rest is "court fees"

with the court fee + traffic school you are basically playing the full price of the ticket. the good part is it doesn't show up on your record and you don't get a point on your license.

i'm not against going in and arguing, but simply walking in and saying "i wasn't speeding" when the cop says "you were speeding" isn't going to get shit done. there are specific ways people contest tickets, and thats what this thread was for. instead its people doing everything except what i asked for :lol

not sure tbh, i'll see when it comes in the mail or i contact the court. if the amount is lower than anticipated, it would make the decision easier. friend of mine paid north of $350 for a red light, not sure how speeding typically compares to that. i just think since it was in such an isolated area, they just write up tickets knowing people aren't going to bother to contest, and thats what pisses me off.

my point is you need to actually make an argument. you cant just walk in and say "i wasn't speeding" or else the judge will just ignore you. this is why i'm asking if anybody here has successfully combatted a speeding ticket before.

They probably scale up the higher you were over the limit, however i dont know about Cali but it would def explain him quoting you high initially. Only thing that i have ever heard of working with any regularity is hoping the cop doesnt show up in court, as djr210 said.

Give the ticket to a cop and tell him to approach the cop who cited you. If he gets to him before he turns in the ticket and convinces him, he'll throw out the ticket before it gets logged.

Of course you'd have to obviously know a cop in the area where you got the ticket or at least know someone who knows a cop.

Once you sign the ticket you are agreeing to do business with the police officer, and the citation becomes a contract. Here's a quote which explains it more from a retired judge..


"The CITATION process can be handled much easier; through the mail. When a Police Officer issues you a CITATION, he is actually requesting you to CONTRACT with him! He is alleging that you violated a corporate regulation in writing, which you have accepted by signing and thus requires you to respond.

The Police Officer is instructed to explain that your signature is merely an acknowledgment that you received a copy of the CITATION but in actuality, your signature is notification to the Court and Judge that you have accepted or CONSENTED to this offer to CONTRACT, which also grants the Judge CONSENT; PERSONAM and SUBJECT MATTER jurisdiction over you and the case!

You can cancel that CONTRACT however my rescinding your CONSENT, within three business days of entering into such a CONTRACT. So across the face of the CITATION you should print or type in large print, the following words:

Like Brazil stated, I'm surprised you didn't at least challenge the officer to review his radar gun - maybe his calibration was off (or most likely BSing).

Just from reading your story though, honestly I'd just pay it and do DD. It just seems like a big hassle burning more gas and time trying to attest the ticket. I remember I was driving at the speed limit of 65, but I passed an unidentified Cop car and the officer pulled me over for go 71. I knew he was BSing, but fortunately the judge dropped my ticket in half and despite myself still on probation (1 month left too), he allowed me to take DD again.

It's amazing to me that three pages in and people are still missing the boat. I understand the process of a not guilty plea. That link you provided didn't even mention a request for discovery, which you always should do before fighting a ticket.

In the OP I explained the situation and I asked if anybody here has successfully pulled off a defense for a speeding ticket. And if so, how exactly they went about it (ie, do you challenge the radar gun, etc)

If you want to challenge police methods and equipment, you'd need a lawyer. Even then, from the details you've described, I doubt he would get you out of the ticket completely.

if you go by yourself, unless you have some solid evidence otherwise (like a built-in speed restricter) the court really will fuck you.

ask one of your professors.

1.) Plead not guilty by mail
2.) Request trial by mail
Good chance the ticket will be dismissed, if found guilty then
3.) Request trial de novo
Only then would you file a discovery request

Then you would go to trial and the Judge will probably dismiss the case because he will realize you are a fucking moron for putting so much effort into a petty traffic fine.

From what I remember, you need to plead "no contest" and request deferred adjudication and sign up for defensive driving. The county may charge a fee. At your court date, take proof of the defensive driving course with you and they should dismiss the charges.

you should always request discovery as early as possible. that would allow you to better prepare your trial by mail. and i never admitted to speeding in this thread. and again, court charges + traffic school will cost as much if not more than the ticket itself. the base fee for a speeding ticket is $35, the rest of it is "court fees" which you'd pay anyway with traffic school.

right. that's what the deferred adjudication does. It will start the process to request a hearing. At the hearing, he will bring the defensive driving proof and then have his chance to adjudicate the prosecution. At that point, he'll either win and all charges will be dropped. Or lose and it will automatically get filed on his insurance.

You sign up for the course. When you go to adjudicate the prosecution, you bring proof of enrollment with you. You go through the hearing and in the end, if successful, you beat the case. And you don't have to actually take the course. It's just backup.

They aren't going to have the fucking DA in there. For traffic violations, it's probably just going to be handed over to a clerk or legal assistant. And really, it doesn't have anything to do with relying on the stupidity of the prosecutor. Although, you sure would not want to try to show up one of the main prosecutors in traffic court.

I've already agreed that it's way simpler and easier to just deal with the ticket. But as per the OP question, I did provide stout legal advice that would give him the best chance of beating the case without having to pay an attorney.

OMG, you're slow. You're not trying to con the judge or prosecutor with the proof of enrollment. But to go through the procedure that I outlined, you HAVE to enroll. It's just bullshit red tape that has to be done. Once you beat the case and it's dismissed, you don't have to take the course.

If you plead "no contest", and then declare deferred adjudication and request for hearing, you will have to have proof of enrollment before they will set the case. Your goal is still to try to beat the case at the hearing.
