Dad is truck driver. Car in front pulls out in front of him and hits my father. Driver claims my dad was trying to "pass" them. Complete bullshit. Dad was trying to get to the side of the road because if he hits them head on he kills them. To make matters worse some guy that "supposedly" saw everything is also blaming my father. Small hick town in the panhandle. Everyone knows each other. Racist and all that mess. State trooper also arrived and harassed and threatened my father. What can we do? Hire a lawyer?

Depends on what you are wanting to accomplish. Did your dad get cited for the wreck? He just has to give his insurance his side of the story and let their lawyers battle it out, and he can take his citation to court. Going to be tough though if he doesn't have witnesses too. If he was driving behind them then the passing story makes sense. If he was driving on the opposite side coming toward them, then the avoiding a head on makes sense. Where was he and where were they?

Or is he just pissed because of how he was treated? He can file a complaint with the State Troopers. I suppose he can hire a lawyer but unless he wants to stick around that town and the lawyer is sure there is a case there he'll probably be wasting his time (and money).

Similar thing happened to me in the middle of nowhere in Puerto Rico. Was running biz for the cartel. Kids pulled their car in front of me. They tried to come out and fight but I was wearing a tank top, they stopped in their tracks :lol

still cops came by they knew the kids so pretty much ignored me. Was thinking of firebombing their car cause I knew where they lived. but just went on my biz tbh

oh and Puerto Rico is a shithole. no wonder them fucks are running to the NYC

Were there any real injuries, or just the mysterious neck/back pain? Also, as UB said the cop probably has a dash cam, so i doubt he'd get hostile for no reason. Your pops was probably frustrated and vented to the wrong guy

I don't see much point in fighting this. Just take the ticket and move on.

Well then you answered your own question. If you're sure a good lawyer can defend him, and it's important that he doesn't eat the ticket, then take it to court.
Seems like a financial question tbh. Is the cost of the lawyer greater than the consequences of him getting the ticket.

This is one of the loopholes of the law. It's a he said she said with no evidence to support either claim. From this point on invest in a dash cam so that no matter what happens you will have evidence as opposed to random unreliable people coming out of the woodwork telling their side of the story.

sounds like investigation of the accident scene coulc have cleared things up, but maybe i watch too much tv and its too late now.

Sounds like he is at fault by law. My dad was a truck driver and he had a couple accidents similar to this. It's bs but he's not going to beat that ticket. They'll just say he should have kept a greater distance from the car in front.

My mom had an accident similar. We turned left at a light and the car in front of us made a right into a gas station just after the light so my mom was going past and the other car suddenly turned back onto the road. I forget whose car actually hit whose but they admitted responsibilty and later told their insurance my mom was at fault. but they paid in the end.

Basic rule of thumb on fault is if the vehicle behind hits the vehicle in front of him it's his fault no matter what. It's the catch 22 that you are supposed to follow at a "safe" distance. Even if the driver in front does something incredibly stupid driving behind "at a safe distance" requires you anticipate stupid. Hitting the car in front proves the following distance was unsafe no matter what.

Nothing you can do. Drivers hate truckers because truckers constantly run smaller vehicles off the road. I see it all the time. The truck gets behind you on a downhill and it's on your ass and the driver is acting like you're in his way. Then you get on an uphill and everyone has to wait for the faggot to grind out 10 gears before moving the damn rig. Then they get side by side, one going 1mph faster than the other and they hang there for 20 miles clogging the entire interstate. Then finally he gets back over and the other does the same thing 10 miles later. This goes on for 300 miles. It's not drafting, they spend more time side by side than in drafting position.

So yeah, truckers are going to be held accountable, and since they often work for larger companies, people are of the mindset that it's the little guy vs big oil, big whatever he's hauling.

However, next time hit them harder. There won't be a ticket, just an investigation and the cops will have to determine who was at fault, and manslaughter could result.

With driving laws and drivers the way they are, any commercial driver should have a dashcam. They are very affordable right now.

Pretty much the only exception is witnesses that will verify the front vehicle pulled out in front, then did some boneheaded maneuver. That's why dashcams are so important today. Wish I had one yesterday in my new sedan. Hit the brakes hard last night, and almost hit an idiot crossing in front of me. I have one in my WS6 Trans Am, but I wasn't driving it.
