If a place is a "privately owned" place, rather "publicly owned," such actions are infringing of the rights of the owners.

just guessing, other than gender normative self-presentation has been more abused than the liberty of business owners to mistreat their employees and guests because of said self-presentation. I do agree that the new rule is meant to curtail the traditional, formerly socially-approved liberty of employers to mistreat queers and other so-called social misfits.
