Things like this need to be discussed because this is how new laws are made. Cases like this arises in-laws change. I don’t particularly like the timing with the orange man trying to control the department of justice but I can see far enough ahead that this is something that needs to be addressed.

I get that it's not unusual for a criminal context to render otherwise legal activities illegal, but it's simply obtuse to insist that this indictment doesn't describe ordinary features of journalism as elements of a criminal conspiracy.

All a President would have to do to neuter a paper is declare it a hostile intelligence service, then go after journos for conspiring with sources.

As unlikely as that eventuality seems, this kind of prosecution can have a chilling effect on the press far short of it..

there is nothing that suggests those acts, in and of themselves, are criminal. in a conspiracy to commit murder, a prosecutor can write that person A bought bleach, person B bought rope, etc when describing the manners and means or "acts furthering" the conspiracy. that doesnt mean anybody who buys bleach is suddenly at risk of being guilty of conspiracy to commit murder
