The case, Montana Department of Revenue v. Espinoza, centers around a tax-credit scholarship program passed in May 2015 that gave Montanans up to a $150 credit for donating to private scholarship organizations, helping students pay for their choice of private schools. The state's revenue department made a rule banning those tax-credit scholarships from going to religious schools before the state's supreme court later struck down the entire law......."

the supreme court has already held that these types of vouchers are constitutional even if they go overwhelmingly the religious schools, because they've said the parents who make the choice act as a buffer between the state and the religion.

i doubt that underlying basis is going to be overturned.

but that doesnt mean that a state HAS to allow a voucher program. this case is basically trying to force montana to have a voucher program...

the problem is that they apparently cancelled the program because the state supreme court determined that money going to the religious schools violated the law, and as a result they just shut down the entire program.

so if they were wrong in their decision making, it could be seen as discriminatory intent

At least in Texas, schools are financed by property tax. That tax is paid either directly or indirectly by the parents. Why shouldn't the parents get a choice on where their education dollars are spent?

I've been in favor for repealing the 10th amendment for a long, long time. It is the responsibility of the federal government to determine taxation (and almost every other major law) in the USA. I support the making of a much more unified, unitary America.

a lot of legal scholars, including many of the founders, thought the 10th amendment (and the bill of rights as a whole, not getting into that) were unnecessary because the constitution lays out what the federal government CAN do, so there was never a need to expressly state that in the 10th amendment. regardless, that still wouldnt stop states from applying their own income tax. you'd need a new amendment to impose that limit on states

the supreme court ruled that the obamacare mandate penalty was effectively a tax, so thats why they said the mandate was legal.
