Court upholds Newsom’s coronavirus ban on in-person church services in California

The 9th Circuit Court of Appeals upheld Gov. Gavin Newsom’s ban on in-person church services, in a split ruling that landed Friday night and is likely to further anger pastors who claim that California is trampling on religious freedoms.

The South Bay United Pentecostal Church in San Diego cannot reopen immediately, the two judges in the majority wrote in their order, because in this case “constitutional standards that would normally govern our review of a Free Exercise claim should not be applied.”

“We’re dealing here with a highly contagious and often fatal disease for which there presently is no known cure. In the words of Justice Robert Jackson, if a “[c]ourt does not temper its doctrinaire logic with a little practical wisdom, it will convert the constitutional Bill of Rights into a suicide pact,’” they wrote.

JC often spoke in parables, driving the moneylenders out of the temple and subsequently saying no physical temple is necessarily to worship or receive religion, do not necessarily conflict.

Not in California though. And let's be clear here, there's no prohibition to practice religion, just a temporary suspension of gatherings.

Plus, the evangelical base was going to vote for Trump anyways, who are we kidding? just like the liberal base, it's not enough to win the election.

Neutral laws of general applicability are the name of the game. Prohibitions on religious gatherings, that don’t target any specific religion and that are passed on neutral criteria like size of the gathering, pass first amendment muster. You can’t say that the prohibition targets any specific religion.

Supreme Court sides with California's religious gathering limit, rejects church's claim

In a 5-4 decision Friday, the Supreme Court ruled in favor of California Gov. Gavin Newsom’s guidance to restrict religious gatherings.

The court denied injunctive relief for South Bay United Pentecostal Church. Justices cast significant doubt on the church’s case, siding with state guidelines that limit attendance in places of worship to 25% or a maximum of 100 attendees.

The precise question of when restrictions on particular social activities should be lifted during the pandemic is a dynamic and fact-intensive matter subject to reasonable disagreement.

Our Constitution principally entrusts “[t]he safety and the health of the people” to the politically accountable officials of the States “to guard and protect.” Jacobson v. Massachusetts, 197 U. S. 11, 38 (1905).

When those officials “undertake[] to act in areas fraught with medical and scientific uncertainties,” their latitude “must be especially broad.” Marshall v. United States, 414 U. S. 417, 427 (1974).

Where those broad limits are not exceeded, they should not be subject to second-guessing by an “unelected federal judiciary,” which lacks the background, competence, and expertise to assess public health and is not accountable to the people. See Garcia v. San Antonio Metropolitan Transit Authority, 469 U. S. 528, 545 (1985).
