In all likelihood nothing will come of this, and both Dorsey and Trump know it.

It's not about actual regulation, it's just more pig's feed to promote conservatives' feelings of persecution. The whole thing would fall apart in court. But that doesn't matter to Dear Leader's flock of useful idiots.

"Alternative platforms" is a reference to non mainstream platforms and to my knowledge he doesn't have a presence on any of them.

The endgame of getting people away from platforms that add biased messages seems pretty obvious.

In the process of twisting my comment to absurdity you claim I'm the person that does not care about truth. Ok.

You want the President and Republican politicians to move en masse to a smaller platform that you can't even name, where their messages will be unimpeded by editorial criticism or context. If the President of the United States uses an account other than Twitter to communicate with the public, that platform becomes mainstream. And you want that platform to be friendly towards, and uncritical of, outright dishonesty by the most powerful people in the country.

Hate to say it, but the right is just as bad as the left and this is just a small sample of one's chosen party supporting the opposite of what you thought it was against. Once you can accept that, you will begin to experience a sense of freedom.

Censorship is as rampant as ever and media is in full propaganda mode. Scary times. I'm pretty sure Trump and Pelosi enjoy cocktails together watching the masses fall for all this bs.

There's no agreement/disagreement on whether the cop and the MWGA hat are the same person. It's a question of fact.

Likewise, if Twitter wants to add links or context to Presidential statements so users can easily get more information or decide for themselves, I see no problem with that. They could have just removed his tweet, but they didn't.

Article II of the U.S. Constitution vests executive powers in the President, makes him the commander in chief, and requires that the President “shall take Care that the Laws be faithfully executed.” Laws can also give additional powers to the President.
While an executive order can have the same effect as a federal law under certain circumstances, Congress can pass a new law to override an executive order, subject to a presidential veto.

(Good luck getting 67 Senators to override a veto to the rejection of an executive order. :lol)

lets assume just for the sake of argument that we agree about the first two sentences.

do you have an issue with corporations attempting to alter the outcomes of elections? should companies not be able to endorse candidates or run ads? should they be allowed to make campaign contributions? why is social media the exception?

they're not foreign agents or foreign governments. what's wrong with americans trying to influence the outcomes of elections? thats what campaigns are all about

I have a problem with their unique usage of their platform. Yes, I see it as different than individuals making donations. They have unprecedented power and they wield it with a biased agenda. That's why big tech is a threat to our country. That's why I'm a proponent of a mass effort to shift people from very biased platforms like Twitter.

1. "The investigation did not establish that members of the Trump Campaign conspired or coordinated with the Russian government in its election interference activities."

2. "The investigation examined whether [contacts between Russia and Trump figures] involved or resulted in coordination or a conspiracy with the Trump Campaign and Russia, including with respect to Russia providing assistance to the Campaign in exchange for any sort of favorable treatment in the future. Based on the available information, the investigation did not establish such coordination."

3. "The investigation did not establish that [Carter] Page coordinated with the Russian government in its efforts to interfere with the 2016 election."

4. "The Office did not identify evidence in those [contacts between Russians and people around Trump after the GOP convention] of coordination between the Campaign and the Russian government."

5. "The Office did not identify evidence of a connection between Manafort's sharing polling data and Russia's interference in the election ... [and] the investigation did not establish that Manafort otherwise coordinated with the Russian government on its election-interference efforts."

6. "The investigation did not establish that these [contacts between Russians and people around Trump during the transition] reflected or constituted coordination between the Trump Campaign and Russia in its election interference activities."

Imagine how interesting things would get should the social media giants be declared public utilities. It can also be argued that Twitter has much a monopoly on their social media method as Ma Bell had on landlines when it was broke up. The third and most interesting point is the quantification of money value of a media supporting or trying to derail a candidate. This means that the opinion pieces would have to be looked at as campaign donations and recorded as such. Most of what Fox does would have to be recorded to the the right while CNN and MSNBC would go left. Basically, anytime you insulted a candidate it would have to be recorded as a campaign donation. Facts that are not bent to sway by adverbs would always be allowed, which would actually be the news.

The executive order takes great pains to avoid some obvious constitutional concerns around the White House's ability to dictate how private companies should deal with speech espoused by their users, but it could still run into a range of legal challenges. The White House broadly argues that the top social media platforms should be treated as "public squares" within which speech is protected by the First Amendment, while the tech industry has argued that the law enables private companies to make choices about how they treat content on their platforms.

As written, one section of the order would require the National Telecommunications and Information Administration, a small agency within the Department of Commerce, to file a petition asking the FCC to review Section 230, tech's prized liability shield. The section heavily implies that online platforms could be considered publishers of content under certain circumstances — and therefore could be held directly responsible for the content they host, a nightmare for any social media platform fearing a slew of lawsuits over every moderation decision.

Another section would forward complaints of anti-conservative bias filed with the White House over to the FTC, where they could be reviewed as examples of "unfair or deceptive business practices" — technically one of the FTC's central mandates.

The draft order would also ask the U.S. attorney general to establish a working group "regarding the potential enforcement of State statutes that prohibit online platforms from engaging in unfair and deceptive acts and practices." It would invite the country's state attorneys general — nearly all of whom are already involved in antitrust lawsuits against Facebook, Google or both — to participate in the consultation.

In one section aimed directly at the companies' bottom lines, the draft order would encourage federal agencies to pull back their ad spending from platforms like Facebook and Twitter if it's found the platforms have imposed "viewpoint-based speech restrictions." Federal agencies spent about $1.5 billion on advertising and PR over the last 10 years, according to a recent government report. A significant amount of that money goes toward public service advertisements — for instance, this year, the U.S. Census announced a $500 million public education and outreach campaign featuring more than 1,000 advertisements.

Appeals court ruling suggests little legal traction for Trump's anti-Twitter campaign

A ruling that emerged from a powerful federal appeals court in Washington on Wednesday morning is strong evidence that the courts are unlikely to be receptive to President Donald Trump’s claims that he and his political supporters are being silenced by social media platforms like Twitter.

The U.S. Court of Appeals for the D.C. Circuit resoundingly rejected a lawsuit the conservative legal organization Freedom Watch and right-wing provocateur Laura Loomer filed in 2018 against four major technology companies: Google, Facebook, Twitter and Apple.

Facebook, Twitter and other platforms have banned Loomer, citing anti-Muslim statements.

The unanimous court decision (https://www.politico.com/f/?id=00000172-56e7-dc3e-aff6-5eff48dc0000) from a three-judge panel runs to only four pages, but is dismissive of a wide range of legal claims some conservatives and liberals have leveled at social media firms in recent months.

The appeals court judges said that, despite the companies’ power, they cannot violate the First Amendment because it regulates only governments, not the private sector.

“Freedom Watch’s First Amendment claim fails because it does not adequately allege that the Platforms can violate the First Amendment. In general, the First Amendment ‘prohibits only governmental abridgment of speech,'” the court said.

“Freedom Watch contends that, because the Platforms provide an important forum for speech, they are engaged in state action. But … ‘a private entity who provides a forum for speech is not transformed by that fact alone into a state actor.’ ... Freedom Watch fails to point to additional facts indicating that these Platforms are engaged in state action and thus fails to state a viable First Amendment claim,” the judges added.
