"Texas public school districts risk losing state funding if they shut down campuses solely in response to closure orders issued by local health officials about the coronavirus, the Texas Education Agency announced Tuesday, adding another twist to the weeks-long debate over whether county government leaders can issue such orders.
The reversal in the TEA’s stance brought swift reactions: At least one Bexar County school superintendent talked about a lawsuit, the Boerne Independent School District moved ahead to open schools in two weeks, and some leaders expressed frustration about confusing, even contradictory, directions from the state as coronavirus infections and deaths are increasing by a day......"

"Until Tuesday, TEA officials had said school districts would continue to receive state funding if legally ordered to close campuses by a local health authority.
The change came hours after Attorney General Ken Paxton released a letter — which is not legally binding — in which he opined that state law does not allow local health authorities to order the closure of schools as a preemptive measure to curb the spread of the novel coronavirus.
On July 17, the San Antonio Metropolitan Health District prohibited school districts in Bexar County from returning to classrooms for in-person learning and school-sponsored events and activities, including sports, until Labor Day, Sept. 7.

If you read the details they can still start the first eight weeks on-line only without losing funding. If covid is still raging after the eight weeks they can extend the deadline again. Personally I wish the state would let each city/county decide it's own guidelines under these unique circumstances but I could see how there could be conflict on constitutional issues concerning state/local funding.

Is funding still going to be tied to attendance? So if schools open after labor day and 50% of the students opt for in-person learning, do the schools get 50% of the funding?

Students in my kids' district will need to login and stay logged in til the end of the day to verify attendance. My guess is that it is intended to secure funding.

If you read even more into the details, this also means schools districts can open if they want regardless of what county officials say.
Boerne ISD is opening two schools in Bexar:
"The district said parents at both Fair Oaks and Van Raub can choose which learning option is best for their children and will not be opening school 100% online as Bexar County originally mandated on July 17.
Additionally, the Texas Education Agency stated that campuses that did not offer an in-person educational opportunity would not be funded.
As of Monday, July 27, the district reported more than 65% of Fair Oaks Ranch Elementry School families and more than 61% of Van Raub Elementary School families had selected the in-person option for their children...."

And this is a problem too for households with two working parents (or single parent households). Home schooling for a lot of these kids will happen in the evening and over the weekend
