They have a very good case, by the legal analysis I have read.

Defamation is where you pretty much know what you are saying is untrue, and say it anyway.

Dominions main point is "you said X, but in your court filings, you not only didn't provide any evidence of X, you didn't even mention it as a factor".

You don’t necessarily need to know it’s untrue, you need to say it with a “reckless disregard for the truth.” That’s still a high bar to meet but it doesn’t require that Giuliani have affirmative knowledge that everything he was saying it false.

and just fyi, that standard specifically applies here because dominion (the entity/person who alleges to have been defamed) is a "public figure"

private figures would only need to show negligence.

It'll never go to trial. Dominion will have to reveal how they cheat.

Add fox :lmao

Fox News sued by Dominion Voting for $1.6 billion over election fraud claims.

This story, originally published at 8:10 a.m., was updated at 9:26 a.m.

Dominion Voting Systems on Friday filed a $1.6 billion defamation lawsuit against Fox News, alleging that the network purposefully aired false claims about the the company’s role in the 2020 presidential election in order to boost ratings.

In the suit, filed in a Delaware court, Dominion argued that the Fox and several of its on-air personalities elevated conspiracy theories about the voting company rigging the 2020 election and allowed falsehoods by their guests to go unchecked, including a wild claim that the company’s machines were manufactured in “Venezuela to rig elections for the dictator Hugo Chávez” and that Dominion’s algorithm manipulated votes so that then-President Trump would lose.

“Fox engaged in this knowing and reckless propagation of these enormous falsehoods in order to profit off these lies,” reads the lawsuit. “Fox wanted to continue to protect its broadcast ratings, catering to an audience deeply loyal to President Trump.”

Lol. Pure wishcasting. In the last couple of weeks the court specifically denied the defendants motion to dismiss (including rudy, powell, the pillow man, etc).

det deposition. :rollin

He is well and truly fucked. He outright admitted to a reckless disregard for the truth.

"Sometimes I go and look myself -- when stuff comes up. This time I didn't have the time to do it."
He continues: "It's not my job, in a fast-moving case, to go out and investigate every piece of evidence that was given to me. :lol

Fox propaganda network is going to settle and settle HARD. :lmao

"[correcting mistatments] didn't seem to be the material part of the inquiry," Powell replied.

Rudy says it's not his job to investigate fraud claims before he announces them.
