Not really true, and Mark Morgan is far from an expert on Constitutional matters.

Fact is, despite Congress appropriating money, construction of the wall goes directly to immigration and border enforcement policy, which is well within the reach of the executive. Heck, the CBP is under the umbrella of the executive.

If the money is not spent on the wall, then it has to be returned to the treasury, that's about it.

This is a completely separate argument from whether they should build the wall or not.
