(Reuters) -Dominion Voting Systems Corp on Tuesday sued two conservative media networks, One America News Network and Newsmax Media Inc, saying they defamed the U.S. voting machine company by spreading false claims that it rigged the 2020 election against then-U.S. President Donald Trump.
Dominion also filed a lawsuit making similar allegations against businessman Patrick Byrne, the former chief executive of online retailer Overstock.com Inc.
The lawsuits are the latest legal actions taken by Denver-based Dominion against Trump allies that amplified false theories about the firm.
In each of the three lawsuits filed on Monday, Dominion is seeking more than $1.6 billion in damages, citing lost profits and other harms.

The lawsuits filed by Abby Grossberg, who worked as a senior booking producer for Maria Bartiromo and most recently head of booking for Tucker Carlson, accused Fox’s legal team of having engaged in wrongful conduct as it prepared her for a pre-trial deposition in the election technology company’s case.

well, in the big summary judgment ruling, the court did find that dominion had already established that it was damaged. there is a concept in defamation called "defamation per se" which basically means that the element of damages are met if the nature of the defamatory claim inherently attacks the person/entity's professional/business reputation. ie it would not be defamation per se if i was talking about a famous financier and saying this guy doesnt shower and has bad BO. it has nothing to do with his ability to do business. if i lied and say these guy has a history of embezzlement or money laundering, that would fall under defemation per se. saying that an election service company rigs elections... yeah thats an obvious one too.
so the court found that dominion had already established damages as a necessary element of their defamation claim. the extent of the damages was still to be proven, but i dont think that was the real hang up. the remaining legal issue at trial was whether or not Fox acted with "actual malice" which is always the biggest hurdle in these cases of defamation involving public figures. you have to prove not only that the statements were false, but also that the speaker knew that they were false or acted in reckless disregard of its falcity. its a pretty high burden. there did appear to be pretty solid evidence of that in the released text messages, but the mere fact that some behind the scenes producer or agent didnt believe the claims doesnt necessarily mean that, say, dobbs or bartiromo felt the same way at the time they made their statements
but given the scope of dominion's involvement nationally, i think damages would not have been difficult to drum up

smartmatic would probably have the same defamation per se aspect going for them, but would similarly have to prove actual malice (it was the only issue remaining in the dominion case had it proceeded to trial). but i have to think they would have a much harder time establishing the extent of the damages than dominion would have. if they settle it would presumably be for way less, but the demand in their lawsuit does seem outrageous on its face, imho
ive only worked one defamation case but it wasnt a public figure so rules were very different. no actual malice standard needed. need to just prove that there was some amount of negligence in the statement, and not that they actually KNEW the info was false (or acted in reckless disregard yada yada)
the burden is higher for public figures because they are deemed newsworthy and you dont want to deter journalists/press from reporting out of fear

A lawyer for Ray Epps, the man at the center of a prominent conspiracy theory (https://www.nytimes.com/2022/07/13/us/politics/jan-6-conspiracy-theory-ray-epps.html) about the Capitol riot, sent a letter on Thursday to the Fox News host Tucker Carlson demanding that he publicly retract his “false and defamatory statements” that Mr. Epps had worked as a government provocateur on Jan. 6, 2021, and helped to instigate the mob attack.
The letter to Mr. Carlson from the lawyer, Michael Teter, also demanded a “formal on-air apology for the lies” that have been “spread about Mr. Epps” by others at Fox.
“The fanciful notions that Mr. Carlson advances on his show regarding Mr. Epps’s involvement in the Jan. 6 insurrection are demonstrably (and already proven to be) false,” Mr. Teter wrote. “And yet Mr. Carlson persists with his assault on the truth.”
Letters seeking retractions and apologies are often sent when lawyers are preparing to file a defamation lawsuit.

smartmatic would probably have the same defamation per se aspect going for them, but would similarly have to prove actual malice (it was the only issue remaining in the dominion case had it proceeded to trial). but i have to think they would have a much harder time establishing the extent of the damages than dominion would have. if they settle it would presumably be for way less, but the demand in their lawsuit does seem outrageous on its face, imho
Dominion only operates in NA and only produces voting machines. Smartmatic is a global company, produces many additional products, and has revenues like 3x Dominion. Hence the larger 2.5b claim.
