The Department of Labor is seeking an injunction barring Smoothstack and Kuiper from continuing to demand training repayments from employees, which it claims employees’ wages below federal minimums in a scheme “akin to modern-day indentured servitude,” according to the lawsuit. It also seeks to bar the company from retaliating against employees who file whistleblower complaints.

Labor solicitor Seema Nanda said in a statement that Smoothstack “brazenly disregarded the law by creating a system that traps workers in jobs through outrageous and illegal contracts.”

According to the lawsuit, Smoothstack hires tech workers for a period of two years divided in three stages: First as unpaid trainees for two to three weeks, then as trainees earning the minimum wage of whatever state they reside in, and finally as salaried employees placed with a Smoothstack client, where they earn $60,000 to $70,000 annually.

Smoothstack requires recruits to sign agreements in order to advance through each phase of employment, but does not disclose the TRAP agreements until after an employee has accepted an offer of full-time paid employment with a client, according to the lawsuit.

Employees who leave the company before they have fulfilled their 4,000 hour billable commitment period — about two years — are liable for $24,000 to $30,000 to the companies depending on their time of employment. The TRAP is triggered whether the employee resigns or is terminated for cause before fulfilling the 4,000 hour requirement or if they breach any other part of the commitment.

The DOL further charges that Smoothstack does not pay overtime hours for trainees, who can work as much as 84 hours in a week, and instructs employees not to record hours worked over 40 in a workweek while they are earning the minimum wage.

It is the second lawsuit against Smoothstack in as many years charging the company with violating federal minimum wage standards. Albertsons Companies, Safeway Inc., and The Vons Companies operate 589 stores in California under the brand name banners of Albertsons, Safeway, Vons, and others. In Alameda County, there are approximately 28 Safeway stores.

The civil action and stipulated judgment were filed in Marin Superior Court. The Alameda County DA’s Office’s Consumer Justice Bureau joined the suit with the District Attorneys of Marin, Los Angeles, Riverside, San Diego, Sonoma, and Ventura counties.

TD Bank hit with record $3 billion fine over drug cartel money laundering

TD Bank will pay $3 billion to settle charges that it failed to properly monitor money laundering by drug cartels, regulators announced Thursday.

Three people are dead, including a suspected juvenile shooter, and at least six others were injured and taken to hospitals after a shooting Monday at a K-12 Christian school in Madison.
Madison police erroneously reported that five people were dead and five were injured during a 12:30 p.m. news conference. They issued two updated news releases after the news conference, saying in fact three people were dead, but they offered conflicting information on the number of injured victims. One release indicated six people were injured, and another indicated seven were injured. A Madison police spokeswoman did not respond to calls.

Madison police now say 3 dead, multiple injured in school shooting

Three people are dead, including a suspected juvenile shooter, and at least six others were injured and taken to hospitals after a shooting Monday at a K-12 Christian school in Madison.
Madison police erroneously reported that five people were dead and five were injured during a 12:30 p.m. news conference. They issued two updated news releases after the news conference, saying in fact three people were dead, but they offered conflicting information on the number of injured victims. One release indicated six people were injured, and another indicated seven were injured. A Madison police spokeswoman did not respond to calls.
Just before 11 a.m., police responded to a call of an active shooter at Abundant Life Christian School, 4901 E. Buckeye Road. They found a juvenile dead with a gunshot wound, Madison Police Chief Shon Barnes said. He did not specify the age and gender of the juvenile.
The suspected shooter was a student at the school, Barnes said.

A picture of the Parkland high school shooter, Nikolas Cruz, can also be seen among the pictures alleged to have been posted by Rupnow.

Other posts relating to school shootings include mentions of the Columbine High School shooting and the 2007 school shooting in Jokela, Finland.

In November 2023, a GIF of a gun was posted on the Tumblr account, with text reading, "Happy birthday to me!!!"

In a post on X, the account believed to be used by Rupnow shared a video from the 2015 school stabbing in Trollhattan, Sweden, where the suspect killed a teacher, seemingly targeting people with immigrant backgrounds, according to The New York Times' reporting at the time.

Another post, dated from Dec. 13, is a video of a person taking their own life at a shooting range.

The most recent two posts to the X account were both shared on the day of the shooting at 11:45 a.m. ET and 11:50 a.m. ET, respectively. Walmart using fintech to screw delivery drivers


The Consumer Financial Protection Bureau (CFPB) is suing Walmart and payroll service provider Branch Messenger (https://www.consumerfinance.gov/about-us/newsroom/cfpb-sues-walmart-and-branch-messenger-for-illegally-opening-deposit-accounts-for-more-than-one-million-delivery-drivers/) for alleged illegal payment practices for gig workers.

The accounts also can come with intense fees that, according to the complaint, would add either 2 percent or $2.99 per transaction, whichever is higher. It also says Walmart repeatedly promised to provide drivers with same-day payments through the platform starting in July 2021 but never delivered on that.

The Bureau alleges that for approximately two years starting around June 2021, defendants engaged in unfair, abusive, and deceptive practices in violation of the Consumer Financial Protection Act of 2010, including by requiring Spark Drivers to receive their compensation in Branch Accounts, opening Branch Accounts for Spark Drivers without their informed consent or, in many instances, on an unauthorized basis, and making deceptive statements about Branch to Spark Drivers.



“Walmart made false promises, illegally opened accounts, and took advantage of more than a million delivery drivers,” said CFPB Director Rohit Chopra in a statement. “Companies cannot force workers into getting paid through accounts that drain their earnings with junk fees.” The agency sued both companies in the US District Court for the District of Minnesota.

The DOJ alleged that from 2014 to 2017, American Express deceptively marketed credit cards by using an affiliated entity that made sales calls to small businesses. The company would then misrepresent the card rewards or fees, whether credit checks would be done without a consumer’s consent and submitting false financial information for customers like overstating a business’s income, according to the DOJ.

The department also alleged the company deceived its federally insured financial institution to allow small businesses to acquire credit cards without the required identification. Employer identification numbers are required by law, but the DOJ alleges American Express used “dummy” numbers to open cards for small businesses from 2015 to 2016.

The DOJ said American Express deceptively marketed wire transfer products to small business customers from 2018 to 2021. Employees allegedly told consumers that their wire transfer fees were tax deductible as business expenses when they were not.

The U.S. Department of Justice filed a lawsuit on Friday accusing Walgreens of filling millions of unlawful opioid prescriptions.

The civil suit filed in the U.S. District Court for the Northern District of Illinois Walgreen Boots Alliance, Walgreen Co. and its various subsidiaries alleges the pharmacy giant knowingly filled millions of unlawful prescriptions for controlled substances from approximately August 2012 through to the present. Walgreens allegedly filled prescriptions for dangerous and excessive quantities of opioids, the lawsuit said, including early refills among other prescriptions.

"Our complaint alleges that Walgreens pharmacists filled millions of controlled substance prescriptions with clear red flags that indicated the prescriptions were highly likely to be unlawful, and that Walgreens systematically pressured its pharmacists to fill prescriptions, including controlled substance prescriptions, without taking the time needed to confirm their validity," Principal Deputy Assistant Attorney General Brian M. TD Bank hit with record $3 billion fine over drug cartel money laundering

TD Bank will pay $3 billion to settle charges that it failed to properly monitor money laundering by drug cartels, regulators announced Thursday.

The fine includes a $1.3 billion penalty that will be paid to the US Treasury Department’s Financial Crimes Enforcement Network, a record fine for a bank. TD also intends to pay $1.8 billion to the US Justice Department and plead guilty to resolve the US government’s investigation that the bank violated of the Bank Secrecy Act and allowed money laundering.

The US Department of Justice said in a statement that TD Bank had “long-term, pervasive, and systemic deficiencies” in its procedures of monitoring transactions. The Wall Street Journal first reported the news late Wednesday.

The authorities did catch the original crime caper, of money laundering in 2008 and 2009. The lame excuse was that TD Bank set very ambitious targets for expansion in US markets, particularly New York and New Jersey, without bothering to set up adequate money laundering controls. In a 2013 settlement, TD Bank paid $52.5 million in fines and swore up and down it would implement the needed controls and would sin no more.

Because money laundering continued after the 2013 fines and penalties, in 2023 Toronto Dominion had to pay $1.2 billion to a court-appointed receiver who sued with court permission following a jury verdict that it had assisted another swindler, Allen Stanford, in laundering the proceeds of his massive Ponzi scheme. He was sentenced to 110 years.

Then, due to the continuation of these blatantly illegal practices, on October 10, 2024, two TD Bank entities were forced to plead guilty to conspiracy to commit money laundering and violations of the United States Bank Secrecy Act from January 2014 to October 2023….Toronto Dominion agreed to pay US prosecutors and regulators $3.1 billion in fines and penalties. Criminal guilty pleas by two TD Bank entities and several individuals occurred. More will come. Toronto Dominion’s Directors and Officers simply never stopped money laundering or doing business with crooks and criminals, even after the September 2013 incident and its fines and penalties and being sued by a court-appointed receiver on behalf of Stanford’s victims. According to the US authorities, Toronto Dominion simply continued that money laundering until it was caught again in late 2023.

Door Dash caught ripping off employees


DoorDash will pay a $16.75 million settlement to resolve a probe led by New York officials into the delivery platform's tipping practices.
The settlement will be split among some 60,000 delivery workers — known as "Dashers" — and will range from between $10 and $14,000 per worker, Attorney General Letitia James said Monday.

For years, DoorDash used tips to offset what it paid its Dashers, James told reporters in announcing the settlement.
In an example provided by James, if Dashers were offered a guaranteed amount of $10 for a delivery, and the customer did not tip, DoorDash would pay the Dasher the promised $10.

But if the customer tipped $3, then DoorDash would let the Dasher keep that tip and pay only $7 out of its own corporate coffers.

The practice was kept secret from customers and DoorDash delivery workers, James said. Dashers did not know that their tips were not adding to their income, she said. And customers had no idea that their tips were not subsidizing their Dashers' incomes and were instead helping the company save money.
