“I have always considered it my obligation to pursue justice impartially, without favor to the wealthy or those who occupy important public office, or harsher treatment for the less powerful,” she said. “I therefore deem it necessary to the faithful discharge of my duties to raise the concerns expressed in this letter with you and to request an opportunity to meet to discuss them further.”

Ms. Sassoon, 38, said in her letter that the mayor’s lawyers “repeatedly urged what amounted to a quid pro quo, indicating that Adams would be in a position to assist with the Department’s enforcement priorities only if the indictment were dismissed.”

She also said that Mr. Bove had scolded a member of her team for taking notes during the meeting and ordered that the notes be collected at the meeting’s end.



But the internal investigations ordered by Mr. Bove could prove risky for him. Mr. Bove,

I have received correspondence indicating that I refused your order to move to dismiss the indictment against Eric Adams without prejudice, subject to certain conditions, including the express possibility of reinstatement of the indictment. That is not exactly correct. The U.S. Attorney, Danielle R. Sassoon, never asked me to file such a motion, and I therefore never had an opportunity to refuse. But I am entirely in agreement with her decision not to do so, for the reasons stated in her February 12, 2025 letter to the Attorney General.

In short, the first justification for the motion—that Damian Williams's role in the case somehow tainted a valid indictment supported by ample evidence, and pursued under four different U.S. attorneys is so weak as to be transparently pretextual. The second justification is worse. No system of ordered liberty can allow the Government to use the carrot of dismissing charges, or the stick of threatening to bring them again, to induce an elected official to support its policy objectives.

There is a tradition in public service of resigning in a last-ditch effort to head off a serious mistake. Some will view the mistake you are committing here in the light of their generally negative views of the new Administration. I do not share those views. I can even understand how a Chief Executive whose background is in business and politics might see the contemplated dismissal-with-leverage as a good, if distasteful, deal. But any assistant U.S.attorney would know that our laws and traditions do not allow using the prosecutorial power to influence other citizens, much less elected officials, in this way. If no lawyer within earshot of the President is willing to give him that advice, then I expect you will eventually find someone who is enough of a fool, or enough of a coward, to file your motion. But it was never going to be me.

Please consider this my resignation. It has been an honor to serve as a prosecutor in the Southern District of New York.

Update: Incredibly, that report that a prosecutor had agreed to file the dismissal turned out to not be accurate. Many hours later, after no such filing was actually made a few very bizarre things happened. First, Emil Bove filed a notice of appearance (https://storage.courtlistener.com/recap/gov.uscourts.nysd.628916/gov.uscourts.nysd.628916.121.0_2.pdf) in the case. That is… not normal.


Next, all of the remaining line prosecutors withdrew from the case (https://storage.courtlistener.com/recap/gov.uscourts.nysd.628916/gov.uscourts.nysd.628916.123.0_6.pdf).


Finally, the “nolle prosequi” (a notice saying “we no longer want to prosecute”) was filed (https://storage.courtlistener.com/recap/gov.uscourts.nysd.628916/gov.uscourts.nysd.628916.122.0_4.pdf). But even the way it was filed is weird and somewhat unprecedented. Two lawyers, including Ed Sullivan (who was mentioned above as effectively agreeing to be the fool to protect his coworkers) signed most of the document, but they did not sign the final statement. Instead, there was a further “order” from the DOJ, signed by Bove alone, telling the Court to effectively dismiss the case:

Even the language here is bizarre. The prosecutors don’t get to “direct” the Court to do anything. That’s likely why Bacon and Sullivan signed the part about “respectfully requests” that the Court issue an order. But Bove leaps in, acting like he gets to order around the judge, and separately signs that part.

Around $1.5 million was later returned, the firm said, though by then investor confidence had collapsed.
