LOL...The parents were. Can't say I know the feeling. But when they give so much cash to the gov, it just sucks. To my understanding, they tried to get as many write-offs as possible. Obviously, the IRS begs to differ with the amount they wrote off.

I won't qualify for that this year. Since the marriage, Jess is the breadwinner now and throws me way over the 12,000 limit. I have no idea what to expect this year with the carryover I have from 2004, school loans, a marriage credit, and some type of relief for new homeowners. I hate having my taxes prepared for 40 bucks or whatever the ridiculous fee is but it's getting tricky now. I'll probably just use Turbo Tax again and if it doesn't look right, i'll take it somewhere.

How about these people that pay 200 bucks so that they can get their 1000 dollar refund back in 2 days. That makes no sense.

I was in graduate school when they first changed the rules to start taxing TAs/RAs. There was a lot of opposition to it at the time, and the schools didn't withhold and basically said they weren't going to volunteer the information to the Govt; they'd have to come look for it. So for at least a few years in the 80s very few grad students were actually paying their taxes.

One of my closest friends is a manager at a certain liqour store in the SAC/Trinity area. He gets so many bottles of wine and liquor from vendors as gifts and gives them to me. Well, not the wine, he's a huge wine snob, I really wouldn't touch it either way, but it's pretty great always having free vodka and rum in the house. I'm not talking cheap shit like Skol, Bacardi or Cuervo either.

I had no idea what to expect this year. I had only 7 months of income, but paid a full year's mortgage interest and taxes, and had a chunk taken out for med flex spend. I got everything (W-2, mortgage/tax statement, interest statements) Friday and Saturday, fired up Turbo Tax and... huge refund.

I can use the cash, but damn, I'm going to have to adjust the withholding.

SpursWoman

Me, too ... almost exactly. I didn't work the first 3 months of the year, inherited a house which I refinanced w/an equity loan....so I paid off all of my student loans (all interest deductable) and spent a fortune so far in home improvements (add'l sales tax deductions) Add all the interest & property taxes...plus daycare & the child tax credit, I got an enormous return.

For more home improvements to my Money Pit.

We don't normally have to pay that much, but since my husband received some severance pay last year, it jacked our income up.

This year will be interesting though since we're on our own now. Our accountant is having him pay himself less salary and pay himself dividends for the balance. It's just hard to figure what the right amount is so we don't get reamed come tax time. It's kinda weird paying yourself an income, though.

My wife is trying to screw me on our taxes. We were going to file married jointly, I was the bread winner in the household and my wife only worked like a month. That 's a good question for SW. She's the accountant in here. I would guess since she only made $273 the child deduction wouldn't help or hurt her, but could benefit you. You guys just separated, right?
But again, ask SW...because I don't know crap. I'm just spouting stuff that's sounds like common sense.. :lol

2Blonde
01-31-2006, 03:38 PM
If you want to fight it out in court then you can probably prove that you are the one who is rightfully entitled to claim the child because you can prove you actually financially provided for and lived with the child. But That will take time and money. Like SW said, hurry and file. The first one to file generally gets it. Just file on your own without telling her and claim your daughter. But do it now before she does. Then she will be the one in the position of trying to claim she deserves to claim her. When/if you get a divorce the courts will decide all the future years. In my decree, my ex and split every other year even though my daughter lives with me. If I remember correctly it was because he thought he deserved it because he paid child support. If I had it to do over again though I wouldn't agree to that.

SpursWoman
01-31-2006, 03:38 PM
She can't.

When seperated/divorcing, the IRS will allow the parents to decide between themselves who gets the exemption....the IRS will honor whatever decision you reach. Lacking a mutual agreement between the two, you must fall back on the support test...which is if you provide over half the support for the individual in question. Support includes actual expenditures, such as food, clothing, child care, etc. but also includes a portion of housing and other shared expenses.

But to save all the headaches of fighting it, I'd seriously just hurry up and file.

The thing is she wants to file and claim her to get the money and screw me. I dont really think she has to file but my question is can she? based on that amount and that there was not federal withheld.
If they didn't take out taxes, then she won't get anything back. The child exemption is credited against what you paid to the government in taxes. They don't just give her that amount of money for the child. Is that what she thinks?

She might have found a job with her dad yesterday but, I dont know that it is a "stable income" to support my kid.

Ugh..Good luck, Butta!

My husband just got 2 1099s. 1) I'm sure the have a W-9 on file, and if they don't, they should have asked for one, and 2) If they bothered to look at said W-9, they would have realized he's a corporation.

I just did it in Turbotax real quick....she'd get an EIC refund of $94 dollars. Not the thousands I'm sure she's anticipating. I hope she didn't write checks against it already. :fro

No child tax credit...that's all Earned Income Credit which is completely different. That $94 is all she would get if she filed her $273 w/no taxes taken out right now and claimed your daughter.

If you've gotten big refunds in the past (due mostly to child AND EIC credits) that may be what she's thinking she'll get just because of your daughter. I guess she's not realizing you actually have to work and put in to get any back ... even if what you get back is more than you put in. There still as to be an effort in there somewhere. :lol
