Do we have to all get express written consent for our avatars and sigs? Just wondering if need to get ahold of Matt Groening or if you need to round out some Breakfast club or whatnot permission slips.



Seriously, I am wondering what makes it ok to have photos's and vid's in our posts and posts on major (bigger, more spotlighted) sites but not to links to sites that use NBA material without consent.


I tried to reply right after i posted on that thread but alas, i can't find it now.


Apparently Phase 3 has progressed faster than normal.

And as far as YouTube is concerned...

The Digital Rights Millenium Act ruled that content hosters (like myspace, YouTube, etc) are not legally responsible for the material that users upload to their service as long as the service employs someone who can be contacted by the rights-holder in order to have the copyrighted material removed.

So, the NBA can require YouTube to take down clips (one by one, they can't just say "Take down any clip we own"), but as long as YouTube does it, YouTube can't be held responsible for the clips up at any given point.

If you're concerned about the Spurs taking away your press passes I understand. Hopefully this site will grow and Kori/LJ's influence in the market will become such that you need not be concerned. In my opinion it would be ridiculous for the Spurs to revoke your press passes for something like this.

Answer my question then bitch, i was serious, that's why i said seriously. Do you just pick and choose what's legal or not, did you have a personal grudge against the poster, youtube.com or Clyde, or is there a difference beteween vids of bowen kicking wally or whatnot in a avatar without written consent from the NBA or merely someone not affiliated with the site posting a link to a place not affliated with the site having fun with NBA vids?

Semantics. I suppose you could call it an illegal video. However, the host is doing nothing illegal and there is nothing illegal about linking to it. That is the difficult thing to accept about your action.

I suppose you could call it an illegal video.No consent = illegal. YouTube's ignorance of the content doesn't magically make it legal.

Ultimately it's about what the NBA wants. They are in the process of digitizing most of their library of game footage and have spoken about allowing users to make their own highlight films, mix tapes, etc. It's understandable why they don't want these YouTube vids flying around and why they will use their leverage to keep links to them out of places like this.

The NBA said DO NOT POST LINKS TO GAME VIDEO IN YOUR FORUM. Any such video is illegal -- they (Youtube, etc) don't have copyright permission from the NBA to re-broadcast, distribute, etc it.

End of story.

ChumpDumper isn't being a bitch. He's doing what I asked to protect the site.

If you guys want to start a forum and post video there, by all means, do so.

I give you so much fucking leniency about everything else, I'd think you'd respect the one rule that's very very important to us maintaining this site.

YouTube turning their back on what videos are hosted on their site doesn't mean the videos aren't illegal. They are distributing copyrighted material without permission.

Anyway, end of story.
