Anyone know what the average fine is? The TABC guy told me he was going to make sure i didn't do any jailtime since i was such a "nice" guy.

According to the TABC website: "Sale to a minor is a class A misdemeanor, punishable by a fine up to $4,000, confinement up to a year in jail, or both."

Also: "The retailer could have their license/permit to sell alcoholic beverages suspended for up 90 days, or even canceled. For a second offense, their license/permit may be suspended for up to six months, or canceled. For a third offense within a period of 36 consecutive months, their license/permit may be suspended for up to 12 months, or canceled."

But how old are you and how old was the minor?
If your like 30 and sold it to a 14 year old that seems wack.
If your 21 and sold it to a 20 year old then I dont know.

Its all the same I guess.

The violator will have his or her driver’s license automatically suspended for 180 days upon conviction.

This is my first offense and I have a clean record. It was a TABC sting where they send someone who looks of age into a store to buy alcohol during high traffic hours. I decided to show up 30 minutes early for my fellow co-worker unfortunately, and it happened within 15 minutes of clocking in...The TABC officer informed me that they already nailed 4 other stores that night in Kerrville and surrounding hill country convenience stores. :toast

It happens. I've seen quite a few people get popped on the Riverwalk. Sometimes you just let your guard down and it just happens to be at the wrong time.

But your TABC licsense is gone and you're looking at a hell of a fine.

My grandma got carded at a freaking Wal Mart buying GTA San Andreas as a gift one time. I'd imagine that clerk was probably in your shoes at one point.

My step brother is still only 19 but has no problem getting alcohol whenever he wants, so I'd imagine it's a pretty big problem.

They were carding at the game last night.

My husband went to the bar to get himself a drink and me a margarita. They would only let him buy one drink. And then he got a beer from the vendor in the stands and they carded him. Any other game I've been to, they've never done that.

i imagine he was working retail, sounds like it. the penalties for over-serving someone at a restaurant/bar are pretty steep too. if someone's involved in an accident and they were over-served you can be prosecuted.

Failed to card the minor..I was told by someone who was in the same situation that it is a heavy fine and community service without probation. Thank god for tax refunds!

I had a TABC plant try to get me to sell them alcohol one time when I was a waiter...

It was obvious they were a plant by the way they acted...asked for ID, they said they didn't have any, I said sorry. A few minutes later she came back in with some suits and they talked to my boss...

She loved me forever after that happened.

FWIW, I don't think plants can use fake ID's...I think they can only try to buy it with no ID, and at that time, they had to be a minor. Now I think you can get popped even if they aren't a minor, if you sell it to them with no ID, but it probably won't be as serious of a charge.


I hope you are good friends with your boss...as he will probably lose his license to sell alcohol(which costs thousands of dollars in sales loss, as well as the cost of the license)...or at least get a big multi thousand dollar fine...not exactly the sort of thing that is going to put you at the top of his Christmas Card List.

I was taught that someone sent to test you is told they can never lie. If you ask them how old they are, they have to tell you and they have to show their actual id.

Well, if it was an employee for a business.... this happened to a friend of mine who worked at Handy-Andy at the time...

He got fine like $300.00 and wasn't allowed to sell alcohol/tobacco for a year (lost his job because of it).

The people critizing you about this are fucking assholes (Norcal) and have no idea whats going on.... They probably think about it as you, as a pedestrian, walking to the corner store and some kid outside asks you to buy them beer. If thats the case, then yes its stupid, but anyone questioning an employee of a store about this shit has NO IDEA what goes on. First of all, they usually get the "plants" that look old enough but aren't... trust me its hard to tell. My friend gets them all the time at the bar.

I've tried asking everybody for ID and birthdate in one shift and I got so many fucking remarks. Like, I'm fucking 25 give me my beer I'm like sorry sir the law requires me to ask everybody for there birthdate and/or ID. So now I just stopped asking all together. Usually it's old Mexican day laboreres buying from me, so I'm pretty sure I'm not breaking any law.

18 is old enough to sell by TABC law, I think you have to take a test though if I remember correctly (I think I took one when I was 18 and working at Fiesta Texas). You need to start asking for ID more often unless its obvious, and when I say obvious Im talking they look almost 50. You have no idea what some of these plants look like. Friends bar got popped once (lost alot of money to fight in court so they could keep liqour license) and ever since then EVERYONE shows a valid ID that isnt cracked or anything, otherwise get the fuck out.

When customes are asses to me, just to get at them I ask for ID for Cigs/Booze just to piss them off and I take my sweet time punching in the birthdate.

I have a TABC certification. You are supposed to check ALL ID'S, so it is your fault...they told you that during the certification class.

I actually just took the certification test friday so I could work an event at the Alamodome for an organization I'm with on Saturday. My online class said to card anyone who looks under 30, which is a pretty safe policy.

The way those TABC stings are set up from my understanding, it's pretty straightforward. The kid can't lie, can't use a fake ID, and must say his real age. If nothing else, ask everyone their birthdate even if you don't check the ID - that saves you from getting caught by a sting.
