no really....i did. just got papers about LVNV funding suing my ass for $1700, Best Buy CC from 2003. i thought they were just bullshittin.....maaaan. should i try to settle or get a lawyer? i've done some research on these bastards...they're ASSHOLES.

yeah well lvnv is notorious for this shit...just do a google search for "lvnv sued". i just have to find out if i should fight it or not. the funny thing is...with this new job i'm starting, the plan was to pay everyone off....well if i fight it..they may not get sheeit. one of the things i'm learning is that i can ask for proof containing itemized purchases and because they're just a collection agency, they probably do not have all that information so that looks good in my favor. we'll see how this pans out. it's interesting because i just fixed a laptop for an attorney friend of my wife's. she asked how much she owed me thursday when we dropped it off, i told her not to worry about it but when i needed some legal advice, i'm going to call her. looks like i'm gonna have to use up that favor 2 days later. damn it...i wanted to hold onto that one too. oh well, maybe i'll have to build a network for them and a website.

a collection agency?
that means that best buy done wrote you off....
a collection agency buys the bad debt accounts from stores like best buy and keeps a % of what they collect IF they collect. you don't owe them anything.
if anyone is taking you to court it will be best buy, not the collection agency

Dude...if it's just a collection agency, here's my advice: IGNORE THEM.

They can't throw you in jail for bad debts (at least in Texas they can't, or my happy ass would have been sold for cigs 20 years ago!), and if it's gotten this far your credit's already trashed.

If you respond to a collection agency you are just confirming the debt and they'll come after you even harder. If they're calling you at work, simply tell them to stop or you'll file a harrassment complaint.

I should start my own "Dave Ramsey" type advice show for those of us with fucked up credit...

These type of comments bug me just like the people on the forum who think everyone who chooses to rent instead of buying a house are stupid. Everyone has life circumstances that are different.

I completely understand the curve balls life throws at folks, and have been there myself, and do owe money that I had no business of buying what I did.

But in my most humblest of opinions, if you don't have cash for it, you can't afford it (outside of keeping the lights on and food on the table).

They sue you, get a default judgment and you have 7 years to try and pay it off...$1600 bucks isn't much they would probably settle for less than half before paying a lawyer...about the only recourse you have left to try is too stretch this out beyond the 4 year limit they have to sue you by writing them and asking for a clarification of this debt, or another trick you might use is writing them and telling them to refer this debt to the original creditor....since you did not borrow money from this collection agency you owe them nothing, if you do it in writing they would have to refer this debt back to BB....and BB would be less inclined to sue you.....

There is nothing wrong with renting! We finally bought a house last year, and OMG, it's the biggest expense and worry you can ever imagine. There is always something your house needs.

Is the last time you made any payment on the debt more than 4 years old?

This is critical.

A debt collector or creditor has a four year statute of limitation to sue you--which starts from the date of the last payment made on the debt.

If so--get a lawyer and summary judgment this shit out of court.

Sounds like everyone else is helping out... I hate collection agencies. I had one sue me for an ambulance ride in NYC. I have never even been to NYC! Needless to say it is off of my credit report.

I don't know about that. A buddy of mine owed someone about 4k. True you can't go to prison for that, but the judge can lay down a judgement for the owed amount, and attorney fees. The next step after that is paycheck garnishment where they can take up to 25% of your paycheck. Your best bet before it gets to that point Blizz is to contact the collection agency who is sueing you and work out a payment plan. You don't owe that much. You probably will have to pay something like 50-75 dollars a month. Like I said with my buddy he owed 4k and ended up paying something like 150 a month or something like that. Normally they can work with you if you just call them. I know it sucks, but it sucks even more to have them taking it out your check EVERY week until the debt is paid off.

Nah you can still negotiate even after the judgement is issued by the judge.

Please pay up. Garnishment of wages is a pain in the ass because then it's up to the employer to remember to pay it for you. I hate when I have to garnish someone's wages.

I know that sucks. I need my entire paychecks. I can't afford to have 25% of my wages garnished every week. Forget that!

Usually by the time I get them, we've already laid them off (Ironworkers hired on a as needed per job basis). But if we re-hire them within a year, I then have to remember to garnish.

I had one guy last year that owed so much that the IRS wanted to leave him with nothing per check. Not all garnishments are 25%...some of them they tell you how much to take out after disposable earnings. I told him that he needed to work something out with them or else he was going to get maybe $100 something a week. I think he ended up getting a second mortgage on his house and they withdrew the order. Turns out that he got pulled over after that (in one of our company trucks) and they found Meth on him. I guess that's where all his tax money went. Sad, cuz he was a good guy. Our field supt. made him go to rehab, but I don't know what happened after that.

The 25% is usually what I get from the state.

The IRS has there own table http://www.irs.gov/pub/irs-pdf/p1494.pdf

So the way it works is if you're claiming Single and 1 and are paid weekly, you GET $162.87--everything else after disposable earnings goes to the IRS. I remember having to call them to verify. He worked it out that I took out $125 per check or something like that.
