Either you or your hired legal representative (i.e. lawyer) goes in on your court date, you appear before the Judge, plead no contest and ask to take a defensive driving course...pay your fees...rinse and repeat...

They will then ask you how much you can afford to pay from your fine. Last time I paid $145 from a $210 fine. They'll take your money in cash, check or payment and your speeding ticket will be wiped clean from your record as long as you don't have any other similar violations within the next 90 days.

You will recieve a letter from a lawyer or lawyers about a week before your court date saying they can do this for you but they will charge you for it. It's cheaper to go on your own.

You have different options. Since its your first, you can take defensive driving. You can pay it. You can fight it or you can take probation.

Yea, for the first, its better to take defensive driving, because you aren't on probation, in case for some reason you end up getting another shortly after that one.

If you are in Texas the defensive driving approach is the way to go.

If you are not (your fave team is the Pacers, after all) you might want to get advice from ppl who know state law in your area.

Take defensive driving and it will not show up on your state record only local and the insurance agencies don't have access to that. Additionally, if you take defensive driving, you will be able to use that towards your insurance agency and get like a 10-15% off your premium.

I hought that the only restriction about doing defensive driving is you cannot take the course more than once in a twelve month period of time.

I could be wrong though.

Can you plead deferred adjudication? I thought it was only guilty, not guilty, or no contest....I know that if you plead not guilty, and your going less than 100MPH, and you show up on your court date, the D.A. will offer you a deal to avoid having to place a jury...and that deal will involve deferred adjudication and a fine....

SAPD got me one time at San Pedro and 410 I think... it's been a while since I lived in SA... it was some intersection near the Best Buy across from North Star Mall. It was between 1 and 2AM, and I went through a light and it was yellow. I never saw it turn red but I'm sure it did after I couldn't see it any longer. Sho' nuff the cop comes out of thin air to pull me over for running a red. Then when he is at my window asking me questions, my friend who is riding shotgun intelligently divulges that we were out celebrating his 21st birthday. At this point I was still underage, but I had not been drinking since I was the DD. But I have to "step out of the vehicle, please" to take a mother fucking sobriety test... which was only follow the light and walk the line... didn't have to do the Breathalyzer. Obviously I passed that shit. Ticket ends up being running a red light, in a construction zone, with workers present (at 2AM? fuck you SAPD). I went to court and disputed the ticket at trial, bastard didn't show up but I assume since he was on the job at 2AM, he would either still be working or sleeping and wouldn't make an 8AM trial.

On the other hand SAPD was very prompt and helpful and didn't issue me a ticket when I had an accident when I was 16 that was clearly my fault.

My advice is go to court and hope he doesn't show up, then you don't have to pay shit. I have gotten two tickets from SAPD (the other one was a legitimate violation) and I went to court for both of them and walked both times.

Hell I'm hardly a prosecution lawyer, I just know I've done this in the past and another friend of mine has too.

The city of San Antonio just wants some money even if it's not for the full amount.

That, and if you are going 25 over, or have a commercial DL, you do not qualify for defensive driving.

I have a friend that does that. He has like 3 or 4 warrants for his arrest, and has had them for a couple years now, and still hasn't got caught.

call one of the lawyers who mail you a letter. Pay with a credit card over the phone and they will get it dismissed. You pay the price the ticket would normally have been. No six hours doing defensive driving , no writing to Austin and paying for a driving record, etc.

It is so much easier.

I think here in SA if you have a bench warrent they don't send the dogs after you, just don't get stopped...if you do... TO THE POKEY YOU GO....
