Are people really suggesting that there is some First Amendment concern with Cuban's decision to ban bloggers? Has Cuban become the government?
Is that just Duel's wild assertion?
Freedom of the press can be infringed by private individuals -- it cannot be infringed by the government. Until Mark Cuban becomes the government, there is no reasonable First Amendment argument.

I didn't go for the first amendment side of it (as you heard). But I don't think it's right how Cuban is trying to handle it.

I agree with you and your argument that Cuban is entirely in the wrong here. As you said, if anyone should be more savvy about how to deal with bloggers, it's Cuban. It was interesting how specifically worded the new policy is -- I suppose to ensure that Cuban doesn't ban himself from the locker room as well.
I'm just incredulous that Duel would actually think there's a First Amendment problem here.

Deadspin, a sports blog, noted the irony of Cuban's blogger ban, headlining its item on the Mavericks' new policy, "Mark Cuban dislikes bloggers who aren't him."

It's not like he's William Randolph Hearst and controlling what the public has access to regarding public affairs and such...It's a BASKETBALL team. It's a basketball team that he OWNS.
Who cares? If he wants to shun the public (and the fans), that's his right. He's just going to end up screwing himself over in the end.

He's not trying to take away the dude's first amendment. He's telling him (and others) to stfo of HIS locker-room. Right? Dick move? Sure. But if Cuban owns it then he should be able to set the rules. I'm sure it gets clouded with the NBA's say in the matter, but Cuban = Money = Power.
I don't really care either way but that was my thoughts on it as I was listening to the "let's get an attorney!" hoorah.

He banned someone that was already granted press credentials by the NBA. He can't just change the rules.
I can see saying that he doesn't want any additional bloggers (or whoever) being issued press credentials. But he doesn't have a right to deny him press access just because the blogger (who has already has press credentials) bashed Avery. So now, coincidentally right after the guy bashes Avery, Cuban is banning all bloggers because "the locker room is too crowded." :rolleyes Good excuse. The Mavs locker room isn't more crowded than any other locker room in the league. The only time locker rooms are really crowded with press is during the Finals. The Mavs don't have to worry about that this year.

Wasn't aware of that. If that's the case, the the league should fine him for that incident.
Players get fined for not meeting with the press, so if Cuban denies them access, isn't that essentially the same thing?

As for the call? I only heard half of it. I was listening to the Ticket, all this talk about a new show I had to hear for myself. I must say those two 40 OZ drinking fools didn't sound to bad, I even heard LongHornE call in!
You can tell Kori is a natural for Radio/TV to bad she has no interest in doing either one. I wonder when Kori will be on the Ticket if only she knew someone from that station. I hope you guys tune in Friday around 635 on the ticket I may just raise the bar on talk radio.............again.

Unfortunately ESPN had no idea they was coming to San Antonio and will have no www, rss/IMs/Emails/streaming and text capabilities until June.
