The House Bill was really gonna neuter the statute and make it more of a traditional SLAPP law by tying protected activity pretty close to first amendment issues. I took a glance at the enrolled version a couple weeks ago and it looked like they rolled those changes back. Arguably, I think the text really isn’t that much different, but I think trial courts are pretty hungover on this shit and will construe the statute narrowly. There was a blue wave of democratic judges on the courts of appeal, so they may limit the statute too since they don’t wanna pour out plaintiffs. So it really depends on what SCOTEX does. We had a case where we got a sanction of over 90k (they sued a guy for filing suit, blatant shit) on this shit and our fees, so the other side ended up shelling out like 135k. For us drafting a 15 page motion. So I'm sad to see this bitch go.
