It does bring up the larger point, though. Identity politics is going to play a huge role in who Obama picks and he's getting pressed from all quarters; women, blacks, hispanics, gays, and on and on and on.

Hell, he's even suggested putting someone with no legal background but that has an ability to empathize and settle cases based on a just outcome instead of some "lofty legal theory."

He hasn't suggested it at all. It's been suggested to him. And actually it hasn't, because nobody's said anything about putting someone with "no legal background" on the court. (The Dems didn't like Harriet Miers, Yoni)

Rather, it's been suggested that Obama get someone from outside the lower courts/judiciary, but not someone who has "no legal background". Yoni's just a butthurt little bitch so he made that up. Per usual.

You mean other than Article III, Section 1's statement that "The judicial power of the United States shall be vested in one Supreme Court and such other inferior courts as the Congress may from time to time ordain and establish?"

I really can't imagine how anyone could have read that express provision of the Constitution to allow Congress to enact legislation that created a bunch of federal courts that were jurisdictionally inferior to the Supreme Court. Baffling to me, really.
