Are you sure? If that was the case then why haven't these guys gotten decent offers already? That doesn't sound right to me. If you can just waive them and are off the hook, then I would have thought more teams with cap space would have offered guys like Bynum a contract already.
Maybe they have and there's just not a deal yet?

(g) By agreeing upon provisions (to be set forth in Exhibit 3 to a Uniform Player Contract) limiting or eliminating the player's right to receive his Cash Compensation (in accordance with paragraphs 7(c), 16(a)(iii), and 16(b) of the Uniform Player Contract) when the player's disability or unfitness to play skilled basketball is caused by the reinjury of an injury sustained prior to, or by the aggravation of a condition that existed prior to, the execution of the Uniform Player Contract providing for such Cash Compensation.

Both sides have to agree to such a provision. I doubt that Bynum has any interest, at this point in the process, in accepting a deal where he doesn't get paid in the event of a re-injury.
A somewhat analogous situation happened with Amare when he left the Suns. The Suns were only willing to guarantee three of the five years due to the injury risks and insurance issues. The Knicks were willing to guarantee all five years and assume the risks.
Players won't assume any additional risk until they're convinced that there isn't a single team that will give them a fully guaranteed deal.

The Spurs should take a chance on Bynum. If they're interested in Oden, why not Bynum? He could end up being a bargain.
I would love to have seen Bynum end his season with a well placed elbow smash to Shane Battier's chest during his flop fest, tbh.
