And Roberts didn't say judges don't have political bias. He said there's no such thing as "Obama judges" or "Trump judges", ie: judges subservient to specific presidents.
Blaming the judges also distracts from the real issue here, which is whether the directives are constitutional or not. There's obviously more steps to go through to determine that, that's why the whining is unwarranted.

plus the rationale there is almost entirely political. of the 14 ninth circuit cases reviewed, alito/thomas/roberts/kennedy voted to overturn 13 of them, whereas ginsberg/breyer/sotomayor voted to overturn only 6 of them. the statistics are function of having a conservative majority on SCOTUS, not because of ineptitude or incompetency of the 9th circuit judges
