Would those briefs not be a matter of public record?

This will definitely come to naught.

A much bigger issue is Magic Negro's DoJ whitewashing criminals Yoo and Bybee as having only "poor judgement" in "legalizing" criminal torture.

But Yoni doesn't worry about dubya's politicized/compromised DoJ.

Why does that matter? The fact remains, Holder was asked to provide that information and he failed to do so.

As Senator Kyl pointed out, "Are we expected to believe that then-nominee Holder, with only a handful of Supreme Court briefs to his name, forgot about his role in one of this country’s most publicized terrorism cases?”

    I don't think so.

Are we expected to believe there is not one Republican senator of Republican senate staffer who can use Westlaw?

It's not like the DOJ had a history of improprietary under previous Presidents...

Let's face it; the odds that the DOJ is acting as supposed to, ie. an independent body to review the legality of the president's action, is somewhere between 0 and .0000001 %. As I see it now, the DOJ is there to merely twist facts, find loopholes, and reword laws to make whatever a President does legal, ipso facto. The DOJ has become Nixonian, in essence.
