There's a growing mob-mentality when it comes to the financial elite. From the facts of this article, a case might be had if GS deliberately concealed information (as opposed to not disclosing it). The law in NY is that as between sophisticated parties, only active concealment of material
information is fraud. Is that the case here? I dunno. But what I do know is that Taibbi hasn't presented that case. Rather, he seems to think calling bankers and lawyers heads is enough.
We're a country of laws, not men. Just because you don't like GS doesn't mean they've committed a crime. And that's not to say that there isn't a case against Goldman. But this Taibibi guy isn't making it.
Taibbi is always a good read. Wino has posted many of his articles here on ST

Mob mind does not preclude criminality or the political calculation that prosecution would be inexpedient.
Obama has been more or less supine before the money masters; I'd be surprised if that changed.
per Bill Black, was the matter ever properly investigated prior to the decision not to prosecute? were FBI agents assigned? was a grand jury empaneled?
apparently the legal eagles had no confidence they would win and no desire to even try to vindicate whole communities (Jefferson Co., GA, looking at you) basically bankrupted by Goldman's shenanigans.
