Anyone know what the average fine is? The TABC guy told me he was going to make sure i didn't do any jailtime since i was such a "nice" guy.

According to the TABC website: "Sale to a minor is a class A misdemeanor, punishable by a fine up to $4,000, confinement up to a year in jail, or both."
Also: "The retailer could have their license/permit to sell alcoholic beverages suspended for up 90 days, or even canceled. For a second offense, their license/permit may be suspended for up to six months, or canceled. For a third offense within a period of 36 consecutive months, their license/permit may be suspended for up to 12 months, or canceled."

If your like 30 and sold it to a 14 year old that seems wack.
If your 21 and sold it to a 20 year old then I dont know.

It happens. I've seen quite a few people get popped on the Riverwalk. Sometimes you just let your guard down and it just happens to be at the wrong time.

Was the problem that you failed to card the minor, or that you carded him but he had a fake ID?
My grandma got carded at a freaking Wal Mart buying GTA San Andreas as a gift one time. I'd imagine that clerk was probably in your shoes at one point.
My step brother is still only 19 but has no problem getting alcohol whenever he wants, so I'd imagine it's a pretty big problem.

They were carding at the game last night.
My husband went to the bar to get himself a drink and me a margarita. They would only let him buy one drink. And then he got a beer from the vendor in the stands and they carded him. Any other game I've been to, they've never done that.
i imagine he was working retail, sounds like it. the penalties for over-serving someone at a restaurant/bar are pretty steep too. if someone's involved in an accident and they were over-served you can be prosecuted.
Failed to card the minor..I was told by someone who was in the same situation that it is a heavy fine and community service without probation. Thank god for tax refunds!
I had a TABC plant try to get me to sell them alcohol one time when I was a waiter...
It was obvious they were a plant by the way they acted...asked for ID, they said they didn't have any, I said sorry. A few minutes later she came back in with some suits and they talked to my boss...
She loved me forever after that happened.
FWIW, I don't think plants can use fake ID's...I think they can only try to buy it with no ID, and at that time, they had to be a minor. Now I think you can get popped even if they aren't a minor, if you sell it to them with no ID, but it probably won't be as serious of a charge.
I hope you are good friends with your boss...as he will probably lose his license to sell alcohol(which costs thousands of dollars in sales loss, as well as the cost of the license)...or at least get a big multi thousand dollar fine...not exactly the sort of thing that is going to put you at the top of his Christmas Card List.

I was taught that someone sent to test you is told they can never lie. If you ask them how old they are, they have to tell you and they have to show their actual id.
