New Information: Accused Drunk Driver Has Checkered Past

Deputies say Brian Stone has had seven DUI charges in the past.
MORGANTOWN -- Five people were killed in a car crash at about 10:30 p.m. Sunday on Interstate 68 in Monongalia County, the sheriff’s department said.
Deputies said they have arrested Brian Stone, 32, of Gans, Pa.
Stone is charged with five felony counts of driving under the influence causing death. He also faces a charge of driving under the influence third or subsequent offense.
This is Stone's fifth time being charged with DUI in Monongalia County.
In September 2002, Stone was convicted of first offense DUI in Monongalia County Magistrate Court.
In November 2003, he was arrested in Monongalia County for DUI and other charges, but pleaded to a reckless driving charge.
In June 2004, Stone was again arrested in Monongalia County for DUI. This time he pleaded guilty and was sentenced to home confinement and a $3,800 fine.
In February 2005, he was arrested for DUI with a suspended or revoked license and other charges. He again pleaded guilty and was sentenced to more home confinement.
In March 2007, Stone was convicted of DUI in Pennsylvania. He is currently awaiting trial on a second DUI charge in that state.
In April 2007, he was charged with third offense DUI, back in West Virginia. Stone failed to show up for his preliminary hearing on that charge. That case has been rescheduled for later this month.
Stone was arraigned Monday morning in Monongalia County Magistrate Court on that latest charges.
Magistrate James Nabors set Stone's bond at $1.35 million.
He is being held at the North Central Regional Jail.
The sheriff's department also says that Stone did have a valid Pennsylvania driver's license at the time of Sunday's wreck.
Deputies say the 2007 Ford F-150 pickup truck Stone was driving was traveling east on I-68 near the Pierpont Road exit when it hit a Ford Taurus. The Taurus then crossed the median and slammed into a 2005 Chevy Trailblazer sport utility vehicle that was heading west. The car and SUV both caught on fire.
The sheriff's department has still not released the names and ages of the victims.
Deputies said nearly a dozen people were involved in the wreck.
The seven people who survived the accident were taken to Ruby Memorial Hospital in Morgantown for treatment.
Information has not been available on the extent of their injuries.
The westbound lanes were shut down for several hours while crews worked to remove debris from the accident.
The Monongalia County Sheriff's Department is continuing its investigation.
Deputies ask anyone who saw the accident to call Detective Sgt. Pete Tennant between 8 a.m. and 4 p.m. weekdays, at (304)-291-7218.

I don't think the first DUI(assuming no one else is involved) deserves jail time. Everyone can make a bad judgment call.
For any that follow, jail time is a must as is a PBT attached to your ignition. If you get a DUI while the PBT is attached to your car, your license should be revoked IMO.
I agree with that, but I'll add that if you get a DUI while you have a PBT you should serve a DAMN long sentence... because you would have had to go to some trouble to either disable or "fool" the PBT in order to drive.
You should also have something on your license indicating that you are required to have a PBT so it can be checked any time you are pulled over.
At least this guy doesn't do hard drugs like Shrooms, or Weed.
That's stupid, it's just dumb luck whether you kill a half dozen people or make it safely home.
The idea should be to have such severe punishment that a person wouldn't want to drive drunk even once, because that's all it takes to kill people.
it's sad that the drunk driver's themselves are usually the ones that survive these crashes.

It could but that's not the point, the point I'm trying to make is that the initial punishment should be so severe that it would keep people from doing it in the first place.
The worse the crime the more severe the punishment should be.
Most drunk drivers probably don't think they are going to kill five people, so if the law is that if you don't kill anyone the punishment isn't too severe, most drunks will go ahead and drive, thinking they won't kill anyone and won't get into too much trouble.
This guy got four slaps on the wrist and that's exactly how he wound up with five DUIs.
Here I'll use your post: Most people who speed probably don't think they are going to kill five people, so if the law is that if you don't kill anyone the punishment isn't too severe, most people who speed go ahead and drive 10-15 miles over the posted limit, thinking they won't kill anyone and won't get into too much trouble.
Both are choices and against the law. Both are leading factors(the top two) in auto-related fatalities.
If we are going to be extremely tough on people who drink and drive, shouldn't we be just as tough with people who go 10-20 miles over the speed limit?

Paris Hilton was convicted for one DUI as far as I know. I don't think that deserves jail time.
Yeah, it's hard to cause that kind of a tragedy when you're only driving 10mph.

i've driven drunk in the past. i'm glad i never killed anyone.
I think there's a difference between driving drunk and speeding, but I don't have a problem with penalties that fit the crime, be it speeding, or drunk driving.
The 18th amendment should just be reinstated.
