What this means is that he can have Miers taken into custody by the Sargent At Arms unless she complies with the committee subpoena to testify on the attorney firing scandal

TPM is reporting that Bush is committing a felony (again) by "forcing" Miers not to testify before the Conyers committee
TMPInvoking a privilege is one thing, but telling a person not to show up in response to a subpoena -- if only to actually invoke the privilege -- is quite another. It's not just worse, it's a felony under federal criminal law. See for yourself.
18 U.S.C. Sec. 1505 : ... Whoever corruptly ... influences, obstructs, or impedes ... the due and proper exercise of the power of inquiry under which any inquiry or investigation is being had by either House, or any committee of either House or any joint committee of the Congress ... shall be fined under this le, imprisoned not more than 5 years ... or both.
18 U.S.C. Sec. 1515(b): As used in section 1505, the term "corruptly" means acting with an improper purpose, personally or by influencing another, including ... withholding, concealing ... information.
Like I said, separation of powers. I guess they'll have to start their impeachment proceedings against the President.

Former Bush counsel faces possible contempt charges

WASHINGTON (Reuters) -YahoooooooooA divided congressional panel moved toward bringing contempt charges against former White House counsel Harriet Miers on Thursday after she refused to appear at a hearing on the firing of federal prosecutors.
On a party-line vote of 7-5, a Democratic-led House of Representatives Judiciary subcommittee rejected Miers' contention that President George W. Bush's claim of executive privilege allowed her not to attend its hearing or testify on what she knows about the dismissals.
"We have given all these claims careful consideration, and I hereby rule that those claims are not legally valid, and that Ms. Miers is required pursuant to the subpoena to be here now and to produce do ents and answer questions," said subcommittee Chairwoman Linda Sanchez, a California Democrat.
After her panel approved the ruling, Sanchez said, "This subcommittee and the full committee will take under advisement what next steps are warranted."........
Looks like it contempt for Miers....
Don't in your pants yet...it'll go to the courts and get bucked up to the Supremes before she wears any handcuffs or sees the inside of a jail cell.
