Lawsuit of the Day: Greer v. 1-800-Flowers
If you're a married man planning on sending flowers to your mistress, we have a tip for you: do NOT use 1-800-FLOWERS (as if you needed to be told).
Check out this interesting case, filed in the Southern District of Texas (Houston), and included in this morning's Courthouse News Service (subscription):
Leroy Greer v. 1-800-Flowers.Com Inc.
8/6/2007
H-07-2543 (Houston)
Breach of contract action in which the defendants agreed to keep the plaintiff's order of flowers for his girlfriend private, with no record of the transaction mailed to him at his home or office.
Months later, the defendants sent a thank you card to the plaintiff's home, and his wife called the defendants for proof of the purchase. The defendants faxed the plaintiff's wife proof of his order of flowers for his girlfriend, which resulted in a divorce being filed.
Oh crap. In terms of tales of infidelity getting exposed, this one is definitely up there.
If plaintiff Leroy Greer prevails, what would be the appropriate measure of damages? Will 1-800-FLOWERS reimburse him for his divorce settlement, as a form of consequential damages?
And what about alimony -- will they pick up the tab for that? Or can they just send his ex-wife a bouquet of carnations each month, for the rest of her life?
Correction: Thanks, commenters. Scratch the reference to "alimony," and replace it with "spousal support."

This guy should be more careful when cheating on his wife. You don't want to catch any FTDs.

he ain't big pimpin no more....
They should offer a coupon and tell him to go himself.
Personally, I didn't think it was that funny.
I did....that guy is a dumbass.![]()
No he's not. Don't you for a minute think your "guy" is not ing some other on the side, because I can guarantee he is.
Just because your girl got pollinated elsewhere doesn't mean everybody does.
If he still has the energy for extracurricular sex, at least he's smart enough to not leave any evidence.
Most men don't have the energy for extra sex.... they take away the affection from their spouse in order to give to their girlfriend.....
Men are dumb......and funny all at the same time...![]()
My friend got caught in a similar fashion. His wife found out he was renting a hotel about 10 minutes from their house. I had no sympathy for him...
if the plaintiff has sufficient evidence of an agreement, then he will win, otherwise this case will be thrown out.
They would have gotten a divorce sooner or later, right? In any case, 1-800-Flowers just helped things along...
I guess their relationship wilted when she found out.....
The only thing worse than a cheater is a lazy cheater. If he'd of stopped by a florist he could have paid cash, used any name he wanted, and no one would have been the wiser.
I think I'm going to have to publish the charlatan's handbook. People suck at being sneaky these days.
will she want half the settlement if he wins?
He deserves that just for wasting time to buy flowers for a mistress.

‘Men bored with marital sex after five years’
ABOUT 80% of married men face erectile dysfunction five years into their marriage because of having a single sex partner, China Press reported yesterday.
It quoted Singapore's Dr Yu Wei Siang, who is otherwise known as Doctor Love, as saying that 50% of men faced the problem with their sex partner after being married for between three and five years and 80% of them after being married for five years.
The paper said it was normal for a married couple to experience low libido after having the same partner for a long period of time.
Dr Yu was invited by the Johor Baru Tionghua Federation to speak in Johor Baru about sex on Sunday.
Most members of the audience preferred to ask questions via SMS.
He advised married couples to take the trouble to look for new environment and stimulation.
ya think?
haha, that advice is worth it's weight in gold. Brilliant!
