39-43 would get you a top-10 pick, but not a top-5 pick. I'd prefer it if the Mavericks remained in the playoffs, to give the Spurs/Lakers/Hornets as much as they can handle before the Suns reach them.

After researching Mock Drafts for about 45 seconds, here's a list of who the Mavs could possibly get with a pick in the 8-12 range...

OJ Mayo
DJ Augustin
Chase Budinger
Roy Hibbert

We could get Kidd's replacement (Augustin), a true center (Hibbert), or that elusive shooting guard we've been searching for (Mayo, Budinger).

I think tanking is the most logical option.

we have next year's 1st rounder. We can tank that one instead. Announce Dirk will miss the season with an injury. When people ask "what injury?" they can just say "whatever David Robinson had".

Actually, I thought the Mavs should have made major moves last offseason but seems like they went with the whole "67 game" win bull , now they went and got Kidd more than halfway through the season in an incredibly tight race in the West and are feeling the growing pains and also the fact that they are not the top team anymore..

The Mavs have easy schedule to finish off the season and can get a top4 seed, why tank it now? Next year's crop of freshmen is a mediocre one filled with Bargnani type players...good ones but no standouts.

I don't think the Mavs have a chance at the Finals but they can get to the 2nd round and 3rd if they're very lucky.
