    JOHN J. MCCONNELL, JR., United States District Court Chief Judge. This case concerns the Trump administration’s efforts to dismantle federal agencies that are responsible for, among other things, funding museums and libraries, mediating labor disputes, supporting minority-owned businesses, and preventing and ending homelessness in the United States. By now, the question presented in this case is a familiar one: may the Executive Branch undertake such actions in cir vention of the will of the Legislative Branch? In recent months, this Court—along with other courts across the country—has concluded that it may not. That answer remains the same here.
    Plaintiffs are twenty-one states (the “States”) that challenge the legality of Executive Order 14238, “Continuing the Reduction of the Federal Bureaucracy” (“Reduction EO”). The Reduction EO had the effect of dismantling the Ins ute of Museum and Library Services (“IMLS”), the Minority Business Development Agency 2 Case 1:25-cv-00128-JJM-AEM Do ent 99 Filed 11/21/25 Page 3 of 47 PageID #: 5399 (“MBDA”), the Federal Mediation and Conciliation Service (“FMCS”), and the U.S. Interagency Council on Homelessness (“USICH”) by withholding alreadyappropriated federal funding from these agencies, terminating numerous grants and programs that these agencies administer, and placing many of the agencies’ employees on administrative leave.

    The Court determines that the States are en led to further injunctive relief. First, the States have demonstrated actual success on the merits of their claims: Defendants’ implementation of the Reduction EO violated the APA, the Take Care Clause, and the Separation of Powers doctrine.

    A federal judge in Washington on Friday issued an order blocking the IRS from sharing taxpayer information with U.S. Immigration and Customs Enforcement, finding the practice is "unlawful."
    The Court "concludes that the Plaintiffs have shown a substantial likelihood that the IRS’s adoption of the Address-Sharing Policy and the IRS’s subsequent sharing of taxpayer information with ICE were unlawful under the Administrative Procedure Act," U.S. District Judge Colleen Kollar-Kotelly wrote in a 94-page ruling.

    In an order issued today, a federal judge in Washington clarified that any effort by Acting Consumer Financial Protection Bureau (CFPB) director Russell Vought to allow funding to lapse based on a theory that the Federal Reserve has no “combined earnings” from which to draw would violate her previous ruling to keep the agency open.

    Judge Amy Berman Jackson intimated that Vought could be held in contempt of court if he used this dubious interpretation of the CFPB’s funding structure.
    Vought’s reasoning “is contrary to the text and intent of the statute and the way it has been consistently interpreted by both the Federal Reserve and the CFPB,” Jackson wrote.

    Earlier this year, the American Civil Liberties Union, the ACLU of Massachusetts, Protect Democracy, the Center for Science in the Public Interest, and Emery Celli Brinckerhoff Abady Ward & Maazel LLP filed a lawsuit challenging the abrupt cancellations and stalled application of grants on behalf of individual researchers, along with the American Public Health Association (APHA); the International Union, United Automobile, Aerospace and Agricultural Implement Workers of America (UAW); and Ibis Reproductive Health.

    This agreement does not impact the first phase of the case, in which the U.S. District Court for the District of Massachusetts found NIH’s directives to be unlawful and vacated grant terminations. In August, the U.S. Supreme Court ruled that the district court likely lacked jurisdiction to review the termination of research grants by the NIH. However, the Supreme Court declined to stay the district court’s conclusion that the directives violated the Administrative Procedures Act (APA). The District Court’s decision is on appeal and oral argument will be heard in the First Circuit Court of Appeals on January 6, 2026.
