In a civil case, not criminal. There is a reason the plaintiff filed for criminal charges in the conservative state of Colorado but then filed a civil suit in the state of California for a more lucrative settlement since CA does not cap awarded damages like CO. It might require some critical thinking but I'm sure you can handle it.
