no, the civil suit will be a lower burden of proof. he can't be tried again for murder or manslaughter in Florida, but he can be sued for the loss of life. he can even face federal, criminal charges

I am arguing that the state shouldn't have to prove that you didn't shoot someone in self defense. The state should have to prove that you killed someone and at that point it is up to you to prove that you had good cause.

Someone on top of you beating you seems like good enough cause to me. You seem like a sensible and rational person, I don't see why you wouldn't do the same. Now if you don't own a gun I could see how shooting someone in that situation could be a foreign concept.
