The NCAA has UNC dead to rights. While The UNC fans go on and on about "how the NCAA can't tell schools how to grade papers or teach classes" and may be right, the NCAA investigation and charges have NOTHING to do with that part of the scandal. The NCAA notice of allegations indicts UNC on 5 charges and are all related to IMPERMISSABLE BENEFITS.
Allegation 1: PAGES 5-7 Impermissible benefits provided by academic counselors and staff members
A-1) UNC academic conselors, through faculty and staff members, provided impermissible benefits to athletes that were not availble to regular students.
"The special arrangements athletics academic counselors provided to student-athletes cons uted impermissible extra benefits and included, but were not limited to, requesting certain course offerings within the AFRI/AFAM department on behalf of student-athletes, contacting individuals within the AFRI/AFAM department to register student-athletes in courses, obtaining assignments for classes taught in the AFRI/AFAM department on behalf of student-athletes, suggesting assignments to the AFRI/AFAM department for student-athletes to complete, turning in papers on behalf of student-athletes and recommending grades."
A-2) Anomalous courses that were listed as lecture courses but were presented to student athletes as the infamous paper courses. The NCAA delievers a particuarily scatching indictment of the nature of these courses,
"(the classes) were taught as independent study courses with little, if any, attendance requirements, minimal to no faculty interaction, lax paper writing standards and artificially high final grades. In some instances, athletics academic counselors with in ASPSA made special arrangements and used these courses to help ensure the eligibility of academically at-risk student-athletes."
While UNC fans / supporters propagandize that the NCAA can not punish them for the nature of their courses that is clearly not what the NCAA is doing. The NCAA specifically mentions that these courses are considered impermissible because the add specifically, "The high level of involvement by athletics academic counselors in the administration of these anomalous AFRI/AFAM courses relieved student-athletes of the academic responsibilities of a general student."
B) UNC allowed 10 student athletes (names redacted) as evidenced by transcripts to violate university policy to keep them eligible. UNC has a 12 hour limit to independent studies courses that can count towards graduation but when players needed to maintiain eligibilty they were put in classes falsly listed as "lecture" courses when in fact they were taught as "independent studies" or "paper classes". This shows the lack of ins utional control in the fact that the school cant even control the listing of classes correctly to insure eligibility standards are met (being on track to graduate is one of them). The NCAA specifically mentions in conclusion that, "this serves as part of the basis for the Lack of Ins utional Control Allegation In Allegation No.5."
LEVEL) Allegation 1 is considered "a severe breach of conduct (Level I) because the impermissible extra benefits provided over a nine year timespan seriously undermined or threatened the integrity of the NCAA Collegiate Model, in particular, as articulated in NCAA Cons ution 2.5. The provision of impermissible benefits in an academic context underminds the importance of a student-athlete's participation in his or her own education. The conduct also provided, or was intended to provide, a substantial or extensive impermissible benefit."
*The NCAA has a seperate do ent containing the exhibits (which they call "Factual Information" or and annotate as "FI") which they use to prove these charges which I will link from later. Many of these aren't opinions but undeniable black and white emails. The words are right there and can not be changed or argued. The overwelming majority of these come from the "Wainstein Report" which did much of the investigation for the NCAA.
There are 217 emails referrenced as evidence used to prove allegation no.1 and many are also used to prove allegation no.5 . These emails involve all major sports.
For example...
FI5-FI25 are emails from Jan Boxhill. Boxhill who was the Head of the UNC Parr Center for Ethics (not surprising the ethics head would be knee deep in corruption as a place with no ethics) and a philosophy professor also was a academic conseslor for Women's Basketball and for a time served as the PA announcer at Womens Basketball home games.
5-25 deal with Women's Basketball
FI156-FI78 are emails involving Janet Huffstetler, Jenn Townsend and Wayne Walden who all worked with mens basketball. Walden in particular was listed as "Men's Basketball Staff" in the UNC Program for several years and worked with Roy Williams at Kansas.
156-178 deal with Men's Basketball
These sports were indicted numerous other times but thats just a couple big groups to show the nature of the evidence.
There are also emails that specifically deal with 'Olympic Sports' conselours and even Women's Soccer and Women's Field Hockey Student Athletes. Emails that involve Football, Baseball, the UNC Compliance Office, and the Head of Undergraduate Education who had oversight over all the undergraduate classes.
Allegations 2 deals with Jan Boxhill (the Ethics Department Head and women's basketball advisor) and specific allegations against her involving adding content to student-athletes papers and suggesting grades to faculty for student-athlete papers.
Allegation 3 deals with Deborah Crowder (the non faculty administrator who did most of the leg work implementing the scam such as changing grades, registering athletes for class, communicating with professors and athlethic advisers as a middle man, etc) and her Failure To Cooperate
Allegation 4 deals with "Dr." Julius Nyang'oro (the chair of the "African and Afro-American Studies Department" where the fake classes occured, as well as a professor) and his Failure To Cooperate including Refusing To Furnish Records Upon Request
All 3 of these allegations, like the first, are termed "severe breaches of conduct" / Level I which is the most severe violation.
Allegation 5: Page 52 - Lack Of Ins utional Control
This alleges the "scope and nature of the violations" in 1 and 2 show lack of ins utional control. It lists specifically Failure To Monitor Boxhill (Allegation 2), Lack Of Ins utional Control Of Student-Athlete Advisers Who Provide Impermissible Benefits To Student Athletes (Allegation 1) as well as Failure to Monitor the AFAM Department where the fake classes occured which allowed the department to create "analous course" (the ones where they are listed as lecture classes but in reality are no show independent studies classes) for 18 years unchecked.
Contrary to the propaganda of UNC fans when they say "the NCAA didn't mention men's basketball, it's all about women's basketball and a little bit football" the REALITY of the situation is all 3 sports are specifically listed in the Lack Of Ins utional Control Charge.
The NCAA summarizes on Page 53 " This allowed individuals within ASPSA to use these courses through special arrangements to maintain the eligibility of academically at-risk student-athletes, particularly in the sports of football, men's basketball and women's basketball. Although the general student body also had access to the anomalous AFRI/AFAM courses, student-athletes received preferential access to these anomalous courses, enrolled in these anomalous courses at a disproportionate rate to that of the general student body and received other impermissible benefits not available to the general student body in connection with these courses."
Allegation 5, like all other allegations is Level I severe breach of conduct.
Ins utionally UNC is facing four "Aggravating Factors".
1. Multiple Level I Violations in fact all 5 violations are Level I severe breaches of conduct.
2. History of Level I and Level II or Major Violations listed here are two previous violations. While the 1961 case of improper entertainment and lodging doesn't matter the NCAA does mention that on March 12, 2012 they were sanctioned for violations regarding academic fraud, impermissible benefits, unethical conduct, failure to monitor, preferential treatment, failure to cooperate and failure to report outside income.
3. Lack Of Ins utional Control in it of itself is aggrivating. Speficially the involvement of "Jan Boxhill, then philosophy instructor, director of the Parr Center of Ethics"
4. Persons Of Authority Condoned "Boxhill abused her position as a faculty member by providing impermissible academic assistance.
UNC is also facing two more "aggravating factors" for the failure of Boxhill and Nyang'oro to cooperate as well as two more "aggravating factors"for unethical conduct on behalf of Boxhill.

This is the physical evidence and much of it is simply undeniable in the form of email. Other evidence includes previous studies done on the nature and extent of the classes, the student academic transcripts for the 10 violators of Independent Studies course hour limits, transcipts of interviews with the involved parties (save for Crowder and Nyang'oro who did not cooperate), tables and charts showing the number of athletes involved, and more. Many of these interviews were not released by the NCAA to the UNC itself at the time of the notice and the transcripts are all redacted under "student privacy laws".
