After Cohen raid, prosecutors ask Trump Org to turn over records related to Stormy Daniels payments


In what appears to be a new development, federal prosecutors in New York are now asking the Trump Organization for records related to attorney Michael Cohen's payment of $130,000 to adult film actress Stormy Daniels.

The request came in connection with raids by the Federal Bureau of Investigation Monday on the office, hotel room and home of Trump lawyer Michael Cohen.

Mr. Cohen made the payment to Stephanie Clifford, a former porn star known professionally as Stormy Daniels, less than two weeks before the 2016 presidential election.

That prosecutors are asking for these do ents immediately after the raid on Cohen's office,

a raid in which do ents related to this same payment reportedly were seized, seems significant—and

the risks to the Trump Organization have now been heightened.

The new request poses a key risk to the Trump company,

now ostensibly helmed by the president's son, Donald Trump Jr.

After the Cohen raid, prosecutors now have in their possession whatever do ents Cohen himself had related to the Daniels payment—

including, presumably, any records of his communications with Trump and his company over the matter.

If the Trump Organization is not forthcoming with those same do ents,

prosecutors will be able to argue to a judge that the company is intentionally withholding information related to the investigation—

potentially setting up a warrant, and a raid, on the Trump offices themselves.

While I haven't fully thought it through, Stormy's position is still a tough one. She signed the contract and received the 130k payment. That should be enough to have the agreement be enforceable against her as a matter of law (at least here in Texas; I don't know if California law is different). The typical rule (again, in Texas) is that all you need is for the party against whom enforcement of the agreement is sought to a) have signed and b) receive consideration.



I don't really buy the meeting of the minds argument. Cohen likely had actual or apparent authority. It's been years since I've looked at what those rules are, but it feels like Trump wouldn't need to know about the agreement itself so long as it appeared that Cohen had authority to act on Trump's behalf (at least in the eyes of Stormy). And that rule makes sense -- a principal (as in the principal-agent relationship) having to know exactly what his agent was doing would really defeat the whole purpose behind the law of agency.

But again, I haven't really thought this through much and I don't know California law, so I'm more than happy to be wrong on this. Maybe my yeghpire spurraider21 has more insight.

That's an argument that the defense will certainly rise. But the answer of that question lies in how the FBI handles the evidence, and also what's in it.

attorney-client privilege is not an unlimited privilege, there's some exceptions, like when a crime has been committed.

Like I said earlier, this is all entertaining, but the fun doesn't really start until there are indictments, and what are those for.
