    Supreme Court rejects final Trump bid to nullify 2020 election results

    The Supreme Court on Monday denied a bid by former President Trump to nullify his electoral loss in Wisconsin, rejecting the former president's final pending appeal over the results of the 2020 election.

    In an unsigned order without noted dissent, the justices declined to take up Trump’s lawsuit alleging Wisconsin election officials violated the Cons ution by expanding absentee voting amid the global coronavirus pandemic.

    The justices’ move brought an end to Trump’s scattershot and ineffective legal campaign to overturn President Biden’s victory and added to the abysmal post-election court record of Trump and his allies, which included more than 60 losses and just one narrow win.

    Trump sued in Wisconsin more than a month after Biden won the state by just over 20,000 votes.

    His lawsuit claimed that policies put in place by the Wisconsin Election Commission to mitigate the spread of the coronavirus — like establishing absentee ballot drop boxes — illegally usurped the state legislature’s sole power over election rules.

    When he filed the suit in late December, Trump had asked the court to fast-track a review of his case ahead of the Jan. 6 meeting of Congress to certify the results, a request the justices denied.

    In a December phone call with the chief investigator in Secretary of State Brad Raffensperger's office, former President Donald Trump insisted he won Georgia's presidential election, telling the investigator "the country is counting on" an audit that was launched to determine whether the signature verification process for mail ballots was done properly in the state's third largest county, according to a newly published audio recording obtained by The Wall Street Journal.

    "This country is counting on it because it's very interesting. ... I won everything but Georgia, you know, and I won Georgia -- I know that -- by a lot, and the people know it, and you know, something happened there. I mean, something bad happened," Trump told the chief investigator, Frances Watson, according to the recording of the six-minute call.

    The former president goes on to tell Watson, "When the right answer comes out, you'll be praised. ... People will say, great, because that's -- that's what it's about, that ability to check it, and to make it right because everyone knows it's wrong."

    The existence of this new audio recording comes amid a criminal probe of Trump's efforts to overturn the results of the November election in Georgia, which he lost by 11,779 votes. At the center of that investigation, which was launched by the Fulton County district attorney's office last month, is an hour-long phone call Trump had with Raffensperger on Jan. 2. In that call, Trump spewed baseless conspiracy theories and falsehoods about the election and pleaded with Raffensperger to "find" the exact number of votes he needed to win Georgia. Trump has denied wrongdoing, and his impeachment attorneys disputed he "acted improperly in that telephone call in any way."

    A spokesperson for Trump has not responded to ABC News' request for comment.

    Raffensperger announced on Dec. 14 that investigators in his office, in coordination with the Georgia Bureau of Investigation (GBI), would conduct a signature match audit of absentee ballot envelopes, saying there were specific and credible allegations that signature matching wasn't done properly by election officials in the June primary. A total of 15,118 absentee ballot oath envelopes, which is where voters sign, were randomly selected to be audited.

    The audit was completed on Dec. 29, and investigators only discovered two ballots that should not have been accepted as they were and should have undergone the "cure" process. But the GBI director also made clear that neither of those two ballots were fraudulently cast.

    According to the recording, Watson assured Trump that her team and the GBI are "only interested in the truth and finding, you know, finding the information that's based on the facts."

    ABC News previously reported on this call's existence in January. At that time, a source familiar with the matter said Trump had told Watson to "find the fraud" and that she would be a "national hero" for it. Those exact words are not spoken in the audio recording of the call. In a follow-up conversation, that source told ABC News that that was how Watson had interpreted the president's words and how she described the call to this source.

    When the call was first reported on, ABC News did not identify the investigator because the source sharing the call's details asked Watson remain unnamed due to the threat environment election officials were facing. In this recording, however, Trump identifies her by name.

    ABC News has reached out to Watson for comment about the call and audio recording, but has not heard back. However, ABC's Atlanta affiliate, WSB, also obtained the recording and spoke exclusively with Watson.

    RICO expert hired by prosecutor investigating Trump call

    An expert on Georgia's racketeering law was sworn in Wednesday to help the prosecutor who's investigating potential efforts by former President Donald Trump and others to influence last year’s general election.

    Fulton County District Attorney Fani Willis has engaged John Floyd to serve as a special assistant district attorney to work with lawyers in her office on any cases involving allegations of racketeering, her spokesman Jeff DiSantis said. A Fulton County Superior Court judge swore him in Wednesday morning.

    In letters sent to state officials last month asking them to preserve evidence for her investigation into potential attempts to influence last year's election, Willis mentioned racketeering as one of the possible violations of Georgia law that she was examining.

    Floyd previously helped Willis when she used the Georgia Racketeer Influenced and Corrupt Organizations, or RICO, law to prosecute nearly three dozen Atlanta public school educators accused in a cheating scandal. In April 2015, after a trial that spanned months, a jury convicted 11 former educators of racketeering for their role in a scheme to inflate students’ scores on standardized exams. Willis was a lead prosecutor in the case while working for her predecessor, former Fulton County District Attorney Paul Howard.

    Floyd will remain employed by Atlanta law firm Bondurant Mixson & Elmore and will be available to help Willis as needed. He was not being retained for any particular case and could be consulted on possible racketeering violations in a variety of areas, including prosecutions of white collar crime, gangs and public corruption, DiSantis said.

    Willis's office has confirmed that the investigation into potential efforts to influence the election includes a Jan. 2 phone call in which Trump urged Georgia Secretary of State Brad Raffensperger to “find” enough votes to overturn Joe Biden’s win in the state. Willis has also said she has questions about a call U.S. Sen. Lindsey Graham made to Raffensperger, the sudden departure of a top federal prosecutor and statements made before Georgia legislative committees.

    She wrote in the letters to state officials Feb. 10 that her office had opened a criminal investigation into “potential violations of Georgia law prohibiting the solicitation of election fraud, the making of false statements to state and local government bodies, conspiracy, racketeering, violation of oath of office and any involvement in violence or threats related to the election’s administration.”
